A Study On The Legal Protection Mechanism Of Readers' Rights

The rights of readers are based on the identity of readers,and the basic cultural rights of citizens stipulated by the constitution are implemented in the public library.The rights of readers mainly include equal access,free choice and free access to basic services.The law of the People's Republic of China on public libraries does not explicitly mention the concept of readers' rights,but many of its articles can deduce the two rights of equal access and free access to basic services in readers' rights.Current legal safeguard mechanism of readers' rights still exists many problems: the first is the problem of insufficient legislation,the public library law of the People's Republic of China,the existence of the provisions of the readers' rights is not clear,the public library obligations is not comprehensive,and violators of legal responsibility of violation of readers' rights provisions are not clear,most of the compulsory rules do not have complete structure and other issues;In addition to the same problem of unclear legal liability for tort,the local public library legislation also has the problem of general and incomplete contents.Secondly,it is the realization mechanism of readers' rights,which is hindered by the lack of government support for public libraries,the poor service consciousness and quality of public libraries and the indifference of readers' own rights protection.Finally,there is the problem of relief mechanism.Most local public libraries have failed to establish an internal appeal mechanism for the protection of readers' rights,and their cultural departments have not set up institutions to resolve disputes overreaders' rights.The effective realization of readers' rights can be guaranteed from the following three aspects: first,to improve the legislative achievements related to readers' rights as soon as possible;Second,the government,public libraries and readers should make concerted efforts to improve the realization mechanism of readers' rights.The third is to establish a relief mechanism for readers' rights.To be specific,local public libraries should establish an internal appeal mechanism for the protection of readers' rights,and the cultural administrative departments responsible for the management of local public libraries should set up internal institutions to resolve disputes over readers' rights.
