A Study On The Legal Thoughts Of The《The Book Of Shang Jun》

The so-called "one hundred dynasties are governed by Qin political system",a complete centralized system established by Ying Zheng,the founder of Qin Dynasty,has been ruling China for more than two thousand years,and the rise of Qin Dynasty is inseparable from a Wei descendant named Gongsun Yang,namely Shang Yang.Qin Xiaogong made great use of Shang Yang and made great efforts to reform.Politically,Shang Yang reformed the household registration,military title,land system,administrative division,tax,measurement and folk custom of Qin state,and formulated harsh laws;economically,Shang Yang advocated emphasizing agriculture,restraining commerce and rewarding farming.In one fell swoop,it became the most powerful country among the seven heroes of the Warring States period,laying a solid foundation for the Qin system.《The book of Shangjun》 also known as 《Shang Zi》 is a collection of Shangyang’s words,deeds,thoughts and works of Legalist school.It is one of the representative works of Legalist school.The book solves the theoretical basis of the reform under the current conditions,and puts forward several major principles of reform,including both macro theory and specific laws and regulations,which still have reference significance.In this paper,from the principles of legislation,the policies implemented in the reform,the role of law,the characteristics of law,the implementation of law and other aspects of the 《book of Shang Jun》to study the legal thought contained in it and the reference significance for the rule of law in the new era.
