Research On The Problems And Legal Response Mechanism Of Network Public Opinion Supervision

With the rapid development of China's social development process,the rapid development of network technology,the rapid spread of all kinds of information in the network,has a huge impact on people's life,work,study and entertainment.People have gradually become accustomed to using various social software,forums and other channels to freely express their opinions and opinions on the situation.The rapid spread of these views in the network has formed the network public opinion.In special events,the network public opinion has played a certain role in promoting the development of the event.Especially in the current situation of the comprehensive promotion of we media,the speed of its dissemination and the wide range of audiences have profoundly changed people's social way.We media platform has brought freedom of speech to the masses.At the same time,some netizens' behaviors such as "spreading rumors","network violence","insulting and slandering others" in the network are becoming more and more serious.Internet rumors mostly focus on hot news facts,and then they fabricate various details to exaggerate.The articles are mixed with falsehood and reality,which makes people feel better than the pure fabrication in the past It's harder to tell the truth from the false.With the strengthening of the state's network supervision,a large number of illegal and criminal cases of network public opinion show the original form of crimes under the close supervision of the public security organs.Those who violate the "criminal law" will be punished by the criminal law no matter whether they know the law or violate the law unintentionally.At present,the novel coronavirus pneumonia epidemic prevention and control situation is grim in our country.In order to do a good job in epidemic prevention and control work,maintain order and social stability in epidemic prevention and control,and effectively protect the people's lives and health,it is based on the People's Republic of China criminal law,the People's Republic of China Public Security Management Punishment Law,the People's Republic of China Emergency Response Act,and People's Republic of China infection.According to the relevant judicial interpretations of the Supreme People's court and the Supreme People's Procuratorate,public security and other law enforcement departments will seriously deal with and severely crack down on the following behaviors in the current epidemic prevention and control work.If it is an illegal act,administrative penalty shall be imposed according to law;if a crime is constituted,criminal responsibility shall be investigated according to law.In the circular on novel coronavirus pneumonia prevention and control,the following provisions are stipulated in the circular: "ten,fabricate false epidemic information,spread rumors of epidemic situation,report false cases,fabricate false epidemic prevention and control measures,disrupt the order of epidemic prevention and control,knowingly make false information,and deliberately propagate through We Chat,SMS and Internet,create panic and disturb social order.Yes." However,punishment is not the ultimate goal of a country ruled by law.The goal of our country's rule of law is to let netizens have a correct understanding of freedom of speech,safeguard national network security,maintain network order and protect citizens' rights and interests through supervision.Therefore,how to effectively solve the practical problems caused by network public opinion has become an important issue at present.This paper aims to understand the current situation of supervision and management of network public opinion at home and abroad,and grasp the concept,characteristics and work content of network public opinion supervision and management.In the research process,the communication change attitude theory,the new public service theory,4R crisis management theory and other theories are taken as the theoretical basis.Through the analysis of the current situation of the Internet users exposed in the online activities,such as disturbing public order,infringing citizens' privacy,influencing public order and good customs,existing network defamation and spreading inflammatory speech,etc.,the existing problems of network supervision are reflected.It mainly includes: first,the legal regulation of network public opinion is not comprehensive;second,the response mechanism of network public opinion needs to be improved;third,the processing capacity of network public opinion is not good;fourth,the supervision of network public opinion in the era of big data is facing arduous challenges.Through the research,from the perspective of legal response mechanism,this paper puts forward four improvement countermeasures for network public opinion supervision and management: first,formulate the legal response principle of public opinion supervision and management;second,improve the Legislative Countermeasures of public opinion supervision and management.In terms of legislation,we should speed up the construction of the legal system of network public opinion control,standardize the standards and procedures of network public opinion control,improve the law enforcement countermeasures of public opinion supervision and management,and strengthen the organization construction of network supervision and management by improving the team construction,improving the accountability mechanism,and strengthening the construction of network culture.It is hoped that through the analysis and countermeasures proposed in this paper,we can provide new ideas for the supervision of network public opinion while bringing convenient advantages to our country in the face of multimedia.
