Under the background of the rapid development of sharing economy,the emerging ride-hailing service has improved the user's travel efficiency,accelerated the taxi Internet process,effectively promoted the reform of public vehicles,and provided millions of jobs for the society,which has great prospects for development.The promulgation of the interim measures for the management of online taxi business services and the interim measures and implementation opinions of various localities have solved some problems in the development of online taxi service,but there are still gaps and deficiencies in both the administrative legislation and the administrative supervision.From the perspective of administrative law,this paper studies the regulation of online car-hailing in China by means of comparative study and inductive study.In terms of theory,this paper introduces the balance theory of administrative law and the theory of responsive regulation,and constructs a regulation model with the government as the leading role and ride-hailing enterprises and industry associations participating together.In practice,this paper analyzes the three weak aspects in the regulation of China's online car administration law,namely market access,personal information protection,the status quo,problems and reasons of the vehicle insurance management system.Then,it makes a comparative analysis of the different models of market access,personal information protection and vehicle insurance management in the United States,the United Kingdom and Singapore,and sums up the experience that is worthy of reference in the regulation of the administrative law of online car hailing in China.Finally,based on the actual situation of our country,this paper puts forward some Suggestions to improve the regulation of the online car rental administration law.First of all,under the administrative law regulation objectives of ensuring user safety,improving administrative efficiency and transforming government functions,the regulation and legislation methods of online ride-hailing should be adjusted.On the one hand,it is necessary to renew the concept of regulation and transform from the direct and unilateral regulation mode to the cooperative regulation mode of "government-enterprise-industry association".On the other hand,the level of online ride-hailing legislation should be improved.The state council should issue administrative regulations on regulating online ride-hailing operations and set the licensing standards for market access of online ride-hailing.Secondly,this paper puts forward some Suggestions to improve the regulation of the online car-hailing law.First,in terms of market access system,we should scientifically set the standards for market access of platforms,vehicles and drivers,and establish a new audit mode of "government-platform-driver and vehicle".Second,the legislation on personal information protection should be promoted as soon as possible,industry norms should be improved,and the scope of information collection and processing by online car-hailing services and third-party platforms should be clarified.Improve the technical level of data supervision departments and personnel,and transform the way of data management.Thirdly,the situation of vehicle insurance purchase should be included in the examination of market access;To specify the insurance that the vehicle must purchase and the applicant and the amount insured;Adopt sectional insurance scheme to ensure full coverage of vehicle operation insurance.Finally,it is necessary to build a new administrative supervision system for online car hailing,improve the credit investigation system,and improve the supporting mechanisms for regulation such as the platform's first compensation system.
