The Checks And Balance Between Media Supervision And Judicial Trial

According to the sociology of system theory,in order to keep the system running reasonably in the complex environment,it is necessary to set up the closure of norms in this system.Media Supervision and judicial trial are two major systems in social life,it is necessary to establish functional communication between them to form a normal closed operation system,and there are still many problems and obvious deficiencies in this respect in China.This paper defines the concept of media supervision and Judicial Trial and discusses the theoretical significance and practical value of handling the relationship between media supervision and judicial trial.Combined with the reality of our country,this paper points out all kinds of abnormal phenomena in the process of judicial power exercise and media supervision.The supervision function of the media is becoming more and more obvious,however,the unrestricted media right will bring the adverse influence to the normal judicial trial,even result in the "media trial".On the whole,as the "fourth kind of power",the media of our country obviously shows the lack of continuity and initiative.Judicial trial in practice also shows the rejection and passive acceptance of media supervision,and the lack of corresponding restrictions and sanctions on the media that clearly violate the law.In order to achieve a balance between media supervision and judicial judgment through game theory,this paper uses case study,theoretical analysis,and summing-up methods,it is pointed out that the lack of effective and comprehensive media supervision in judicial trial is not only incomplete supervision but also imperfect judicial publicity.At this stage,China's judicial trial needs to be more open and inclusive attitude to take the initiative to accept media supervision.The media should follow the positive direction and the objective neutral principle under the active participation,through the cultivation of the value of both the joint realization of social rule of law to a higher dimension development.
