An Empirical Study On Circuit Trial System In Ethnic Areas

Circuit trial as an important judicial system in our country,although its development has experienced a tortuous course,but after the fourth plenary session of the 18 got rapid development,especially the Supreme People's Court in the nationwide successively set up six circuit court,to tour around the basic people's court trial work provides a blueprint,thus promoted the development and the improvement of the system of assizes.The establishment and operation of the circuit trial system in the basic people's court is the result of the continuous development of the circuit trial system in China.With the rapid development of China's economy and the acceleration of the construction of socialist rule of law in ethnic minority areas,the number of social contradictions and disputes in ethnic minority areas is increasing,especially the types of contradictions are new and diversified.The traditional dispute settlement mechanism and the "in-court" trial mode are difficult to adapt to the reality that ethnic minority areas are located in remote areas with inconvenient transportation,and it is also difficult to meet the growing judicial needs of ethnic minority people,while the circuit trial system can respond to the diverse judicial needs of dispute resolution in remote ethnic minority areas.Therefore,this article through empirical analysis approach,select marked achievements were scored in the assize system in ethnic minority areas of guangxi zhuang circuit court as a case study,based on the field survey data,the guangxi zhuang circuit court assize,running status and the basic situation of the research work,in order to grass-roots court trial tour to provide referential experience in national regions.In addition to the introduction and conclusion,this paper is divided into four chapters.The first chapter is an overview of the circuit trial system in China,which mainly expounds the relevant concepts and historical development of the circuit trial system.On this basis,the significance of the implementation of the circuit trial system in ethnic areas is deeply analyzed.The second chapter takes guangxi zhuang language circuit court as a case study,specifically analyzes the basic situation,operation status and trial effect of zhuang language circuit court,so as to show the implementation status of the circuit courtsystem in ethnic areas of China.The third chapter,based on the second chapter,deeply analyzes the problems existing in the current circuit trial system in ethnic areas.Assizes fourth chapter from the perfect national regions of all legal norms and solve the problems in the operation of the assizes in ethnic minority areas,both suggest perfecting the assize system in national regions,thus exploring conform to the road of the assizes of regional features in national regions,to better promote the construction of the rule of law in national regions,to boost national modernization management system and management ability.
