Research On Legislation Of Public Participation In Environmental Impact Assessment In China

With the rapid growth of China's society and economy,environmental problems are also getting increasingly prominent.The environmental impact assessment plays an important role in regulating economic development and the sustainability of environmental resources,and public participation in legislation is an necessary requirement of socialist rule of law.The environmental impact assessment public participation legislation not only enables the public to participate in environmental protection,but also to spot the problems in the environmental impact assessment legislation as early as possible,so as to make scientifically sound recommendations,guarantee the democratization of environmental legislation and administrative decision-making,improve the operability of decision-making,balance the interests of multiple parties,and make contribution to the construction of democratic rule of law system in China.However,viewing the environmental mass incidents in recent years,we can conclude that the environmental impact assessment public participation legislation in China is not yet perfect,and even not actually implemented.Therefore,this situation has greatly reduced the effectiveness of public participation and caused problems to be solved.This paper takes the legislation of public participation in environmental impact assessment in China as the research object.Through the analysis of the changes in the legislation of public participation in environmental impact assessment in China,we sum up that there are some problems with public participation in environmental impact assessment,such as the legislative system is not complete,the scope is not broad,the legislative procedure is not sound,and the guarantee of the legislative standardization system is not sufficient.Combined with the experience of the legislation of public participation in environmental impact assessment in the United States and Japan,this paper puts forward proposals to improve the legislation on public participation in the environmental impact assessment,including improving the legislative system of public participation in environmental impact assessment,broadening the legislative scope of public participation in environmental impact assessment,improving the legislative process of public participation in environmental impact assessment,and strengthening the guarantee of legislation standardization system in public participation in environmental impact assessment.
