On The Law Enforcement Authority Of Chinese Police And Its Reconstruction

At present,China has entered the social period of the new era,in which the major social contradictions have changed,the difficulty of social management and control has increased,and the public security situation is increasingly complex.It is urgent for the public security organs to strengthen the control to ensure the stability of social order.However,in practice,there are more and more ACTS that hinder the law enforcement of the police.The low quality of some policemen leads to the dissatisfaction of the public,the relationship between the police and the public deteriorates,and the external environment for the law enforcement of the police is not good,which weakens the law enforcement authority of the police.The weakening of the police's power of law enforcement reduces the credibility of the public security organs,damages the dignity of national laws,and also affects the building of a moderately prosperous society in an all-round way.It is not conducive to the protection of citizens' personal rights and interests,seriously damages the stability of social order,and causes a bad social impact.Therefore,it is particularly necessary to reshape the law enforcement authority of the police,which is also an indispensable prerequisite for building a stable socialist environment in the new era.This paper consists of four parts:The first part is about the concept of police enforcement authority.Firstly,this paper expounds the essential attribute of police and the origin of Chinese police,and introduces the concept and classification of police authority.Secondly,the concept and characteristics of police enforcement authority are discussed.Finally,the constitution of police enforcement authority is expounded.This part is to let us have a basic understanding of the concepts related to police enforcement authority,which will facilitate the following research.The second part of the article is the development of the police law enforcement authority in each period and the concrete manifestation of the weakening of the status quo.On the one hand,it describes the development period of the police law enforcement authority in China since the founding of the People's Republic of China.On the other hand,a statistical analysis of the cases on the Chinese judicial document network shows that the phenomenon of violence against police is very serious in China,and some recent cases also show that the social evaluation and trust of the police are decreasing.Through the concrete description of the illegal infringement of the police law enforcement,it reflects the reality of the weakening of the police law enforcement authority in our country.The third part analyzes the reasons for the weakening of the law enforcement authority of the police.This paper analyzes the reasons for the weakening of police law enforcement authority from four aspects: the problems of the police force itself,the generalization of its functions,the lack of legal guarantee,and the poor law enforcement environment,so as to provide a basis for the countermeasures to rebuild the police law enforcement authority.The fourth part is the path construction of remaking the police enforcement authority.This is the key chapter of this paper.On the basis of the comprehensive study of police law enforcement authority in the first three chapters,combined with the analysis of the weakening status and causes of police law enforcement authority,this paper proposes to reshape police law enforcement authority from four aspects: ontology construction,system construction,law construction and environment construction.
