Optimization Of Regulation And New Administrative Law

Under the background of administrative state,the government assumes more and more responsibilities.Administrative activities should not only meet the requirements of legality,but also achieve the optimal administrative effect and improve social welfare as much as possible.The traditional administrative law with power control as its main content plays a limited role in the optimal administration,therefore,Chinese scholars put forward a new political law based on China's administrative practice and foreign regulatory theory.New administrative law scholars in our country is in the administrative practice and administrative law theory to supplement and reflect on board,the main content is on the basis of the principle of administration according to law,expand the scope of study,will all aspects of the administrative rules and regulations into account and analysis range,such as administrative regulation of the social background,institutional factors,social effect and so on,will be "the best" administrative efficiency at the same time as a basic principle is introduced into administrative law,and targeted to the views of the theory innovation,system construction."Coal to gas" is an important part of air pollution control in China in recent years.In the implementation and implementation of "coal to gas",a variety of regulatory means have been adopted comprehensively,aiming at the management of coal burning consumed by enterprises and households.As the implementation of the policy emphasizes the completion of the set targets within the deadline,local governments tend to adopt specific regulatory forms in the regulation,and eventually encounter difficulties when they achieve excellent results in the control of air pollution,raising the cost of production and living,and affecting the production and operation and people's life.In this paper,"coal to gas" as an administrative case,around the administrative regulation of the development of a detailed review of the process,discussed the factors affecting all aspects of factors,and analyzes the reasons for the administrative regulation dilemma.By referring to the new administrative law theory proposed by Chinese scholars,the author believes that administrative regulation can be optimized inthe following aspects: broadening the research object of administrative law,introducing the basic value of optimal administration,strengthening the public's participation in the administrative process,paying attention to the economic analysis of administrative regulation,and selecting the most appropriate regulatory form.
