As the real estate market continues to expand,housing prices continue to rise,and most people's demand for housing continues to increase.Many people choose to invest in real estate to obtain higher benefits,but many problems have arisen.The State has issued a series of policies in order to prevent house prices from rising and to ensure a suitable living environment for low-and middle-income groups.However,these policies do not protect these disadvantaged groups well.Many people use the form of borrowing to buy a house in order to buy a cheaper house.They sign a contract to buy a house with a borrowed name.The effectiveness of the contract to buy a house under the name,so different people give different interpretations of the validity of the contract,leading to constant misunderstanding and conflict between the parties.This article compares with the entrustment contract,the trust contract,and the gift contract,summarizes the concepts and characteristics of the loan-to-buy house contract,and further analyzes a series of problems caused by it.The article is divided into four chapters.The first chapter introduces two targeted cases,which lead to the theme of the article.The second chapter analyzes the disputes in the two cases,and introduces the concept,validity and effectiveness of the loan-to-buy contract Determination of ownership of the house in the contract.Although a house purchase contract under a name has many similarities with other contracts,it cannot be completely copied from the concept and nature of other contracts due to its strong practicality.Based on the opinions of other scholars,the author summarizes the characteristics of the loan-to-name house purchase contract,and also analyzes how the ownership of the house belongs when the contract involves the interests of others.Chapter III puts forward the problems and risks in the practice of the ownership of the house in the contract in combination with reality.The fourth chapter proposes countermeasures to solve the problem of ownership of the house in the contract from the perspective of the state,society and individuals.
