The rapid development of financial innovation has promoted the emergence of shadow bank and has played an important complementary role to the traditional financial system.However,shadow bank has not been strictly regulated.After the outbreak of the financial crisis,western countries such as Europe and the United States realized the importance of shadow bank supervision and began to implement regulatory reforms and introduced a series of regulatory measures.Although China has not suffered the severe impact of this round of financial crisis,the experiences of the European and American countries in regulatory reform will help build a financial supervision system with Chinese characteristics.This article includes four chapters:The first chapter elaborated the concept of shadow bank,aimed at clarifying the object of supervision and determining the discussion boundary of this paper.Summarized the manifestations and characteristics of China's shadow bank,and further analyzed the necessity of shadow bank legal supervision.On the one hand,shadow bank has a positive impact on the financial system,which is also the reason for supervision;on the other hand,shadow bank The negative impact requires that the regulatory authority must supervise it.The second chapter introduces the current situation and existing problems of China's shadow bank legal supervision system.From the existing shadow bank regulations of our country,the problems existing in legal supervision of shadow bank include: The problem of supervision mode is that the current supervision mode is out of line with the requirements of financial innovation;the problem of supervision subjects and objects is that the regulatory agency is bound by the government and the regulatory agency There is a lack of coordination and the scope of supervision is not clear;there is no relevant supporting regulatory system.The third chapter examines the legal supervision measures of shadow bank in the United States,the United Kingdom,the European Union,and Japan after the financial crisis and summarizes their legal supervision practices.This points out the implications of international regulatory measures for China's shadow bank supervision reforms.The fourth chapter addresses the problems existing in the supervision of China's shadow bank system and discusses suggestions for improving the supervision of shadow bank.Mainly include: forming a unified macro-prudential supervision model;improving the independence and coordination capacity of regulatory agencies,establishing shadow bank self-regulatory organizations,and clarifying regulatory targets;improving information disclosure systems,risk monitoring and prevention systems,firewall systems,expost recovery systems,and international Communication and communication system.
