On The Legal Supervision Of China's Commercial Bank Channel Financial Services

China's commercial bank channel financial management business is a financial innovation products under the trend of financial mixed operation.Commercial bank financing through the trust plans and asset management plan to evade the regulatory requirements and invest in non-standardized debt assets.It financing for the real economy,increase the intermediate income of financial institutions,but also brought regulatory problems.At the same time,channel finance business of commercial banks is a typical business of China's shadow banking.Such financial innovation businesses have special risk characteristics in addition to the common risks.The traditional separation regulation and institutional supervision have been not suited to the cross-financial innovation business,because such financial products usually have cross-market,cross-sectoral and cross-financial business characteristics,the nested transaction hidden the risk of underlying assets,while increasing systemic risk,making investors and regulators unable to obtain risk information timely and effective.This paper firstly defines the concept of commercial bank channel financial services,lists the specific model of channel financial products,and clarifies the context of channel management.Secondly,through the analysis of the risk cases,this paper summarizes the special risk characteristics of this kind of cross financial innovation business.Thirdly,reviews all the regulatory documents in a rigorous manner and sorts out the evolution process of regulatory policies,thus summarizing the deficiencies of the bank supervision system.Finally,according to the risk characteristics and insufficient supervision of the financial management business,the author puts forward some suggestions to improve the supervision system.
