Since ancient times,China has been paying enough attention to the bribery,Legal provisions and explanations,comments about bribery are too numerous to mention.Although there are many legal provisions of the constraints,bribery still occur in reality.And with the gradual development of society,the way of bribery become more and more diversified and hidden.As a set of complex and hidden in a transactional bribery,it happen with a high frequency and it lead to a theoretical controversy.The purpose of this paper is to analyze and understand the transactional bribery systematically,and to analyze the difficulty of transactional bribery in judicial practice.The first chapter mainly discusses the research background,research significance and research status of transactional bribery,including transactional bribery.The second chapter mainly talk about two specific cases.The third mainly analyzes the types and characteristics of transactional bribery from the perspective of jurisprudence.Transactional bribery mainly include three types of low-cost purchase,high-priced sale,and other forms of transactions.The fourth chapter mainly analyzes the transactional bribery from the angle of judicial practice.for the "obvious",the author puts forward the view of according to different regions to develop different proportions and the amount.For the "market price",the author puts forward the minimum discount according to the different characteristics of the new market and the secondary market Price and put forward the view of "actual control" when "trading".In view of the transactional bribery "knowingly" that the author put forward the "amount and presumption combined" to identify.For the nature of "house,car and other items",The author analyze the nature according to different types of transactional bribery,at the same time,its characteristics are also analyzed.On the basis of the study of the scholars,the author puts forward one form about other trade types.The fifth chapter is mainly the author's advice.
