In recent years,China's development in the field of artificial intelligence has advanced by leaps and bounds.The application of artificial intelligence technologies such as automatic driving,face recognition,and artificial intelligence robots has brought many legal problems while facilitating the public life.In July 2017,the State Council issued the "New Generation Artificial Intelligence Development Plan" clearly stating that it is necessary to "grab the major strategic opportunities for the development of artificial intelligence,build the first-mover advantage of China's artificial intelligence development,and accelerate the construction of innovative countries and world science and technology powers.".In real life,as early as 2017,at Baidu's AI Developers Conference,Baidu released the "Apollo" program to announce the opening of an autonomous driving platform.In July 2019,Baidu AI Developers Conference released the "Apollo" 5.0 program,which gave auto-driving in a limited production area and released China's "Automobile Safety White Paper" for the first time.However,as China's legislation in the field of autonomous vehicles is still blank,although autonomous driving technology can indeed reduce the incidence of traffic accidents,future automatic driving will also be a trend,but the probability of a traffic accident is impossible zero.The first part of this paper is introduced from the research background and significance of autonomous vehicles,including the development of autonomous vehicles at home and abroad.This is followed by a literature review at home and abroad,the domestic and international academic research on autonomous vehicles and the discussion on the issue of autonomous car infringement liability.Finally,the research methods and innovations of this paper are briefly introduced.The second part starts from the concept and technical classification of autonomous driving vehicles,and then discusses the legal significance of technical grading.Then it analyzes the particularity of the infringement behavior of autonomous vehicles different from traditional motor vehicles,including the autonomy of driving behavior.The dependence of driving decisions and the breadth of car users.The third part deals with the current legal provisions and deficiencies of autonomous car infringement liability,and explores the legal status of autonomous vehicles,the principle of liability for tort liability,and how to assign responsibility to different subjects.The fourth part is the extraterritorial legal provisions on the tort liability of autonomous vehicles.Specifically,the United States,Germany,the United Kingdom,and Japan have borrowed foreign advanced legislative experience to promote the development of China's autonomous driving automobile industry.The fifth part is the perfection of the auto-driving car tort liability system.Firstly,it denies the civil subject status of autonomous vehicles,and believes that it can only become a "object" in civil law.Secondly,it clarifies its infringement liability principle and the responsibility distribution of different infringing subjects.Finally,it is about perfecting the auto-driving vehicle supporting system.Suggestions are to establish a sound liability insurance system and improve the regulatory system.
