| With the prosperity and development of online game live streaming industry,a number of new types of intellectual property issues have also emerged in the field of online game live broadcast.In 2015,the Yaoyu v.Douyu was of landmark significance,which brought copyright problems of online game live broadcast into the public.So far,the discussion about the copyright of online game live broadcast is making a great clamor.There is no denying that online game live screen faces challenges.Firstly,the copyright of live broadcast images and the attribution of works are in a state of confusion.Secondly,the positioning and rights boundary of live broadcasting platforms and anchors in the live broadcasting industry are a huge controversy.Finally,there is also a lack of unified legal standard for judicial relief of infringement.The basic points of this paper are as follows.First,the online game live screen is divided into two types for discussion.The large-scale live broadcast images of competitions are endowed with the audiovisual works.The small-scale independent live broadcast picture belongs to the video recording product.Second,on the basis of typology,the relevant subjects and rights protection should be clarified.The large-scale live broadcast images of competitions belong to the organizer and should be included in the copyright law system for protection.The small-scale independent live broadcast picture rights shall be negotiated by the live broadcasting platform and the anchor.Last,on this basis,there are two ways to solve the problem.One side,creating a right to communication to the public by combining the right to disseminate information on the Internet with the right to broadcast.The other side,network media will be included in the ranks of broadcasting organizations.In this way,the protection of online game live broadcast screen can be better realized. |
