Research On Penalty System For Breaking Credit

The system of punishment for breach of trust is one of the most important links in the construction of social credit system in our country.Before,our country has established the system of punishment for breach of trust initially,and has obtained the obvious effect in the practice,but because of the complexity of our national conditions,the system of punishment for breach of trust is still facing the formidable challenge.Therefore,it is of great theoretical and practical significance to study the system of punishment for breach of trust.After selecting the topic,the author has written this article by consulting the practical cases of our country and borrowing a large number of domestic and foreign references.This article analyzes the status quo of the operation of the disciplinary system of breaking faith by studying the behavior of breaking faith and keeping faith,so we find out the defect of the punishment system of breach of trust in our country,and put forward the relative perfect suggestion.In addition to the introduction,this paper uses four chapters to study the system of punishment for breach of trust.The first part summarizes the basic contents of the system of punishment for breach of trust,firstly elaborates the meanings of breach of trust and keeping of trust respectively,and analyzes the harm of breach of trust and the value of good faith,thus draws the conclusion that the system of punishment for breach of trust is the inevitable choice for the construction of social credit system.Next,it introduces the specific content of the punishment system of breach of trust in our country,including the current punishment measures,withdrawal mechanism and so on.Finally,it explains the principles of establishing the system of punishment for breach of trust in our country.The second part summarizes the achievements of our current system and points out the problems still existing in the current system.This paper lists in detail the function of our country's social credit system after establishing the system of punishment for breach of trust,and analyzes that there are still some problems in our country,such as the unclear scope of information disclosure and the nonstandard way of punishment,etc.The third part is the introduction of foreign credit developed countries and China can learn from the practice.Taking Germany and the United States as examples,this paper introduces in detail the credit management systems of the two countries,and draws a conclusion that the credit information system and the information sharing platform of ourcountry still have some deficiencies by comparing with the system of punishment for breach of trust in our country,and learn from the practices of other countries to sum up their lessons.The fourth part is also the most important part of this paper,in view of the problems raised in the preceding part,the conclusions drawn from the analysis,as well as the experience and lessons learned,based on China's basic national conditions,the corresponding suggestions are put forward from the aspects of strengthening the legislation and perfecting the joint disciplinary mechanism.
