Emerging fields are developing rapidly,and corresponding groups of new employment have increased in number,and their corresponding labor relations and rights and interests have become increasingly prominent.However,most employees in new employment forms lack corresponding labor rights and rights channels.In this case,national and social policies are on the agenda.The National Development and Reform Commission proposes to continuously improve the employment policies of new employment forms and earnestly safeguard the legitimate rights and interests of workers;the All-China Federation of Trade Unions proposes a work plan to promote the eight major groups to join the unions;Safeguard plans,etc.,provide a good policy environment for the realization of the protection of trade union rights of groups of new employment.Among the policies at the national and social levels,the protection of labor rights and interests of employees at the social level and trade union policies are more direct.This is because in our country,trade unions represent and protect the legitimate rights and interests of workers,and workers also have the right to participate in and organize trade unions in accordance with the law,and through joining the trade unions,rely on the trade unions to carry out activities independently and in accordance with the law to safeguard their own legitimate rights and interests.Therefore,the protection of trade union rights is an effective entry point to solve the labor rights protection of employees in new employment forms.This article uses Shanghai logistics courier as an example to carry out research on the protection of trade union rights for this group.The research theories include labor rights theory,labor market segmentation theory,and trade union theory.Research methods include literature research method,social survey method,and case study method.According to the research theory and research methods,combined with the expert interview method,construct a survey index system,and design a questionnaire and interview outline based on this.The snowball sampling survey method is mainly used to conduct field surveys,and then qualitative and quantitative methods are combined to try to use empirical analysis Methods Analyze the survey data,combine the results of surveys and interviews,analyze the problems and reasons for the protection of union rights of this group,and make suggestions.Through investigation and analysis,it is found that there are problems in the protection of labor union rights in the group of logistics couriers in Shanghai.First,the Courier of the rights of the union security awareness is low;Second,the union rights of the Courier protection degree is low;Third,the enthusiasm of couriers to participate in the union is not high.Further analysis of the emergence of these problems shows that the main reasons affecting these problems include: first,the limitations of existing laws and policies;Second,the special nature of the industry,express terminal is not standard;Thirdly,the individual characteristics and occupational characteristics of the couriers affect the realization of the rights protection of the trade union.Fourth,the basic responsibility of safeguarding the rights and services of the trade union has not been fully played.Finally,the paper puts forward some countermeasures and Suggestions to improve the protection of the trade union rights of the group of logistics couriers in Shanghai.First,it puts forward three principles to be followed to improve the protection of the trade union rights of the group of logistics couriers in Shanghai,namely,the principle of equality,the principle of particularity and the principle of effectiveness.Secondly,three specific Suggestions are putforward to improve the protection of the trade union rights of the group of express couriers in Shanghai,that is,to improve the relevant legal system and policies,to enhance the awareness of the trade union rights protection of express couriers,and to improve the construction of the trade union to promote the realization of the rights protection of express couriers.Thirdly,based on the above specific Suggestions,the feasibility study is carried out from the following three aspects:the couriers joining the trade union has the potential big demand,has the good experimental base,has the certain financial support and so on.
