Research On Legal Supervision Of Insurance Investment

With the development of China's insurance industry,the amount of insurance funds is getting larger and larger.If the insurance funds are not properly invested,it may lead to insufficient solvency of insurance companies,and may also have a huge impact on the target market.Therefore,the investment supervision of insurance funds is An important line of defense in the insurance funds operation process.The main body of supervision of insurance investment legal supervision in China is the state department.The regulatory basis is related laws and regulations and normative documents,etc.,and it is in the most authoritative position in the supervision process.This requires more regulation of the legal supervision of insurance funds,from the legislative,law enforcement to the judicial process of supervision of insurance investment.This paper first introduces the status quo of legal supervision of insurance fund investment in China,and studies the development process of legal supervision of insurance investment in China,and analyzes the existing problems in current legal supervision by combining actual cases with current macroeconomic environment.Drawing on the relevant experience of the insurance industry in relation to the legal supervision of insurance investment in developed countries,it is proposed that China can learn.Only by strengthening the supervision of the entire process of legislation,law enforcement,and judiciary,investment in insurance funds can be more standardized.The author believes that the following points should be made at the legislative level:(1)Differentiate the characteristics of funds to supervise and achieve better matching of assets and liabilities.(2)Implement the investment process of penetrating supervision and comprehensive control of insurance funds.(3)Increase the intensity of illegal punishment and strengthen the authority of the law.(4)Strengthen the information disclosure of insurance funds to make insurance investment more transparent.At the law enforcement level,it is necessary to improve the professionalism of the regulatory agencies and strengthen dynamic supervision.The judicial level must be unified in the application of the law,and it cannot be completely inconsistent with the judgment of the case.
