The rapid development of telecommunication network makes online games popular all over the world.Since 2000,China's online game market has entered a period of rapid development,creating huge economic benefits.However,in the rapid development there is hidden unrest and crisis,in the face of the abnormal demand of a few network users and the huge temptation of economic interests,some businesses move the crooked brain,wantonly production,sales of online games plug.What's more,the online game plug-in has gradually formed different divisions of production,development,operation and sales,which has become a large-scale underground industry.The rampant online game plug-in has seriously disrupted the normal development of China's online game market,destroyed the profit model of online games,and affected the game experience of other players.Due to the lack of regulations and legal construction of online game plug-in behavior,criminal cases of online game plug-in behavior are increasing year by year.How to characterize and regulate online game plug-in behavior has aroused wide attention and discussion,and the legal application of online game plug-in behavior needs further discussion.Starting from the concept of nature and types of online game plugins,this paperanalyzes and studies the typology of online game plugins in terms of copyright law and criminal law,and puts forward its own views and opinions on how to convict and measure the punishment of modified and copied plugins in online games.The text of this paper is divided into four chapters.The first chapter summarizes the use of online game plugins,and sorts out the concept of nature,working principle,causes of flooding and types of plugins.The second chapter introduces the legislation and regulation of the act of making and selling plug-ins.The third chapter mainly from the visual angles of the criminal law,the introduction of these plugins social harmfulness and the difficulties existing in the current judicial practice and law theory,and in case of these plugins analysis of criminal law,the criterions for the conviction of sin and the sin,and the relationship between this crime and those SINS,through dialogue so-and-so and others illegal business case analysis,leads the author to produce network game plugin whether the software constitutes copyright infringement crimes,the crime of illegal business,selling infringing copies,provide intrusion,illegally controlling computer information systems program,tools,the discussion of such crimes,and to describe cases actor constitute what charges give their own opinions.In the last chapter,the author briefly introduces the problems existing in the regulation of China's criminal law in the aspect of making and selling plug-ins,and puts forward corresponding Suggestions such as establishing and improving criminal legislation in related fields,attaching importance to the appraisal conclusion of electronic data,and strengthening comprehensive management.
