On The Contemporary Value Of Marxist Legal View

Comrade Xi Jinping has repeatedly proposed in his 19 th report to "continuously promote the all-round development of human beings",which is determined by the state system of our people's democratic dictatorship and the basic national conditions that have long been in the primary stage of socialism.Promoting people's all-round development conforms to the fundamental interests of the people and is also an important goal and pursuit of a socialist society ruled by law with Chinese characteristics.A good social environment ruled by law is undoubtedly an important condition to promote the all-round development of human beings.The socialist society with Chinese characteristics adheres to the guiding ideology of Marxism,and the construction of a good legal environment also adheres to the guiding ideology of Marxist legal concept.To promote the all-round development of human beings requires not only the free development of individuals,but also the provision of corresponding conditions by society.Due to the long feudal rule of man in traditional China and the imbalance in the development of the rule of law in recent years,as well as the influence of various capitalist laws caused by the rapid economic development since the reform and opening up,it is not conducive to the construction of a socialist society ruled by law,and it is not conducive to the promotion of all-round human development.Therefore,it is necessary to correctly understand the Marxist legal view and its contemporary value.This article first elaborates the formation process of the Marxist legal view,defines the concept,and focuses on the content of the Marxist legal view.This paper discusses the origin,development,economic attribute,essential attribute and value pursuit of Marxist legal view.Secondly,taking the historical evolution as a clue,through analyzing and studying the main contents of China's legal thoughts in different periods and the internal logic of its development,the process of sinicization of Marxist legal views combined with China's specific reality is explained step by step.The thoughts of rule of law in each period are guided by the Marxist legal view,based on the inheritance of predecessors,and combined with the social conditions at that time,the socialist legal thoughts with Chinese characteristics are of theoretical and practical value.Thirdly,it expounds the connotation of human's all-round development from different angles.Through explaining the content of human's all-round development from the angle of "human's subject",it covers the all-round development of human's needs,human's ability,human's social relations and human's personality freedom.From the angle of "historical process of development",it explains that human's all-round development includes equal development stage,complete development stage,harmonious development stage and free development stage.Then from the achievements and obstacles of China's rule of law construction in promoting the all-round development of human beings,the current situation of the all-round development of human beings in China's rule of law construction is illustrated.At last,it expounds the relationship between "law" and "human" in Marxism,and explains that the Marxist legal view promotes the all-round development of human beings.Then,it explains the contemporary value of the Marxist legal view in terms of its role in promoting the all-round development of human beings in the process of building a socialist rule of law with Chinese characteristics.
