Official development assistance(ODA),as a strategic tool for national development,is related to the economic and social development between donors and recipients.In the practice of ODA,there are two modes of assistance,namely conditional ODA and unconditional ODA.In either of the aid model,the condition issues are unavoidable.Starting with the practice of the two modes of ODA at the international multilateral,regional and unilateral levels,this paper analyses the specific operation modes of some representative international organizations and countries,such as the World Trade Organization,the United Nations Development Programme,the Asian Infrastructure Investment Bank,the United States and Sweden.This paper compares the practice and development trend of both conditional and unconditional ODA,and then analyses their respective impact on China.On this basis,from the perspective of international law,this paper argues for the international legitimacy of China's unconditional official development assistance despite of some negative comments on China's ODA,such as the lack of a sound basic law as the basis for assistance,the ineffectiveness and disguised wicked purpose of China's unconditional ODA.Suggestions as to how to rectify the shortcomings of the existing aid system in the case of not making the ODA Act for the time being,such as "improving the use of international platforms","strengthening cooperation with regional organizations" at the level of international law,and "improving the existing legal system","promoting coordination with other departmental laws" at the level of domestic law,are put forward in the final part of this paper.
