Research On The Tort Liability Of Driverless Vehicle Traffic Accident

With the application and development of artificial intelligence and internet technology,the driverless car,a new type of vehicle,has gradually emerged in the vision of human beings.Due to its highly intelligent characteristics,it is different from the traditional "manned" driving car,which brings convenience to human life and also brings many legal challenges.At present,countries around the world have introduced laws and regulations related to driverless cars to strongly support the development of driverless cars.China has not established a complete system of tort liability for traffic accidents caused by driverless cars,relevant laws and regulations are not perfect,and many legal issues are not clear.Driverless cars the advent of tort liability constitute a major change,the article focus on the body of the tort liability of unmanned vehicle traffic accidents fault,causal relationship,and discusses the problem of imputation principle,visit other country advanced legal results,solve the self-driving car traffic accident tort liability related questions,perfect the system of driverless cars tort liability law in our country.The article will carry out research from the following four aspects.First of all,the basic theory of the tort liability of driverless cars in traffic accidents is studied and analyzed,and the legislation status of the tort liability of driverless cars in China is investigated.The legal status of driverless cars is clearly defined as artificial intelligence products,which still belong to "things" and cannot independently bear the liability for traffic accidents.Secondly,based on the unmanned vehicle traffic accidents,the main responsibility of the causation and fault recognition,discuss the driverless cars in different circumstances apply what imputation principle,as well as the unmanned vehicle traffic accident liability of tort liability reason carries on the discussion,to clear the driverless cars liability tort occur problem.Taking the United States,Germany and the United Kingdom as examples,this paper explores the current legislation situation of traffic accident infringement of driverless cars outside the region,and concludes that it can draw lessons from the establishment of strict access standards,the establishment of special regulatory agencies and the application of "black box" devices,so as to provide legal protection for the construction of the tort liability system of driverless cars in China.Finally,some suggestions are put forward to improve the current legal system of traffic accident tort liability in China.Including adding the rules of tort liability of driverless vehicle in the tort liability law,improving the provisions of traffic accident liability in the road traffic safety law,adding the identification of "product defect" and exemption cause of driverless vehicle in the product quality law,adding the insurance subject of compulsory liability insurance and increasing the insurance compensation limit in the traffic compulsory insurance regulations,and improving The supporting legal system of driverless car includes compulsory liability insurance system and social compensationfund system.
