Research On Tort Liability By Driverless Cars ——The Subject Of Responsiblity And Liability Principle

Driverless cars are developing rapidly with 5G intelligence,big data,high-precision map and other technologies working together.As a typical representative of artificial intelligence,driverless cars have been studied and tested worldwide,but they have not been widely applied.The fundamental problem lies in that the responsibility has not been reasonably solved.With the encouragement and guidance of national policies,autonomous road tests have been carried out in various experimental formula through the country.As the last line of defense to protect the rights and interests of the parties concerned,there are some loopholes and ambigious tort liability on laws in the field of autonomous vehicle.On the basis of literature analysis,investigation,evidence collection and comparative studying,this paper studies the challenge of the development of autonomous vehicles to law.With learning experience from other countries about autonomous vehicles,research the subjects who are responsible for the tort liablity from the subject of responsibility,liability principle and other aspect.Figure out that the designer,the producer or the driver who bear civil liability to protect rights and interests of parties.Fairly and reasonably handling the responsibilities of all parties and reconstructing the responsibility are good to improve the law on diverless cars,to resolve social conflicts and to ensure the stability of social operation.
