Research On Copyright Issues Of Artificial Intelligence Creations

With the popularization of computers and the application of "Internet +" technology,artificial intelligence(AI)technology has been continuously developed and improved in recent years.Artificial intelligence is essentially a part of computer science,an emerging science and technology used to simulate and expand the way people think.Artificial intelligence creations are anthropomorphic representations of artificial intelligence products,and refer to the content generated by artificial intelligence technology using certain algorithms.Examples varies from Google robot AlphaGo vs.Go champion Li Shishi to Tencent-developed robot DreamWrite that can automatically write press releases,and fingerprints and voice recognition to the widespread application of smart appliances.Artificial intelligence brings novelty and convenience to people's lives,as the same time has also arisen new challenges in terms of legal protection.This article takes China's first case of artificial intelligence creation infringement dispute as the background,and uses case analysis,empirical analysis,and literature research to study the legal issues of artificial intelligence creation's copyright,attribution and infringement.The first chapter explains the focus of the controversy in this case,that is to say whether the analysis report generated by artificial intelligence in the case can be identified as a work,the ownership of its copyright,and the identification of the defendant's infringement.The second chapter discusses the different stages of the development of artificial intelligence.The creations are analyzed,and the artificial intelligence creations with artificial participation are considered to be feasible through legal fiction.Artificial intelligence creations without artificial participation should be based on their originality,independent personality attributes,and intellectual achievements.The denial is determined to be a work for analysis.In Chapter Three,the in-depth study of theownership of artificial intelligence creation rights in different categories is considered,and the copyright of artificial intelligence creations in different situations can be attributed to designers,users and investors.Chapter Four identifies the infringement and infringement of artificial intelligence creations from the subject and subject of infringement.The article hoping that we can solve the problem of copyright protection for artificial intelligence creations that the existing law can't provide,and then legally protect the copyright of artificial intelligence creations.
