Research On The Influence Of Artificial Intelligence On The Copyright System In China

With the updating iteration of science and technology,the age of artificial intelligence has come.The emergence of driverless cars,artificial intelligence robots and so on is constantly changing the society,making people's life style more automatic and intelligent.As a legal-majored person,our eyes are not only on the social impact of AI,but also on its influence on copyright law and other laws.This paper is divided into seven parts,and focuses on the impact of artificial intelligence on China's copyright system and the response of China's copyright system in the era of artificial intelligence.In this paper,China's copyright system refers to the copyright related legal system in a broad sense,and it not only includes laws and regulations on the general theoretical level and various theories,but also includes the judicial system in practice.The first part is the introduction.The popularity of alpha go,the concern of civil law about the subversion of civil subject status by intelligent robot,and the research on the tort liability of intelligent vehicle by tort liability law,causing the influence of artificial intelligence on copyright system,so as to further lead to the significance and key points of this research.The second part is an overview of AI.This paper introduces the concept definition of artificial intelligence,expounds the diversified concept of AI and the classification of it based on the development stage.In the historical evolution of AI,the development and current situation of artificial intelligence are illustrated by foreign countries and China.The third part is AI to promote the progress of copyright law theory.This is one of the influences of AI on copyright system.Starting with the analysis of the positive influence of AI on copyright system from the perspective of system theory,this paper expounds in detail the enrichment of AI on the object system of copyright and theimprovement of the subject system.This shows that artificial intelligence has a certain role in promoting the progress of copyright legal theory.The fourth part is artificial intelligence to promote the reform of copyright judicial practice.This is the other one of the influences of AI on copyright system.This chapter explores the existing problems of copyright trial system,and the two major problems brought by artificial intelligence are difficult to find out technology and difficult to identify evidence.At the same time,we examine the operation of Internet court trial mode.This shows that artificial intelligence can promote the innovation and reform of copyright trial system in China.The fifth part is the experience and reference of international copyright system.This chapter introduces the TRIPS Agreement and the copyright legislation of the United States and the United Kingdom in detail,and analyzes their advanced legislative experience as well as the enlightenment and reference to our country.The sixth part is the response of China 's copyright system in the era of artificial intelligence.This chapter mainly shows that under the background of AI era,China's copyright system must make and be able to make a positive response.China's copyright system should build a unified standard system of "originality" of works,and define the right ownership of AI generated content,to respond to the theoretical impact of AI.At the same time,we should promote the in-depth innovation and reform of the copyright trial system,accelerate the development of the normalized application of legal AI,so as to cope with the impact in practice.The seventh part is the conclusion.Through the interpretation and discussion of the main points and conclusions in the article,it shows that,as far as the current stage of AI is concerned,as long as China's copyright system can respond positively and positively in a timely manner,follow the trend,innovate and reform,it will be able to achieve win-win development with artificial intelligence.
