Since the 1970s,non-profit organizations have developed rapidly around the world.Chinese non-profit organizations have also developed rapidly with this international trend.In the field of public welfare undertakings,non-profit legal entities play a very critical role and play a very important role.Although the non-profit corporation has achieved remarkable development,it still has a series of development dilemmas,among which the survival problems caused by the shortage of funds are the most prominent.In order to solve their own survival problems,many non-profit legal entities carry out business activities.On the one hand,it effectively resolved its own shortage of funds,on the other hand,it also improved its independence and competitiveness.However,there are some problems in the process of non-profit legal persons carrying out profit-making activities.From a legal point of view,the legal system has unclear definition of this behavior and insufficient regulation,and the existing legal system conflicts with the real society.The current social reality is that non-profit legal persons are forced to carry out business activities due to their survival and development needs,but China's legal system has not yet made clear provisions on this.Rather than simply prohibit non-profit legal persons from carrying out business activities,it is better to regulate them effectively.In order to enable China's non-profit legal entities to conduct profitmaking activities within the rule of law,and promote the healthy and sustainable development of non-profit legal entities,this article,based on the reference to the legislation and practical experience of other countries outsidethe region,combined with the specific situation of the development of nonprofit legal entities in our country Make recommendations on its special regulatory level.It is hoped that through the research in this article,we can provide some supplements to the theoretical research in this field,so that this article has a certain reference value for the healthy and sustainable development of non-profit legal persons in China.
