Legal Prevention To Duty Crime Of Public Security Police

Looking at the present,the problem of duty crime of public security police has attracted public attention,and it is quite appropriate to study such issue.By investigating the situation of the civil public security police duty crime in the city of C,this paper studies the typical job crime sample,systematically discusses the definition,classification and characteristics of the public security police duty crime,analyzes the reasons behind it,and puts forward corresponding legal preventive measures.The duty crime of the public security police is the use of the position by the public security police to deliberately or excessively undermine the functions of the state's public security administration and criminal judicial management,embezzlement and bribery,seeking economic benefits,or abusing power or dereliction of duty.The general term for acts that infringe upon the lawful rights and interests of citizens,society,or the state and are subject to penalties in accordance with the provisions of the criminal law.At present,the current situation of the crime of public security police in our country is long-term existence,and most of them are induced by psychological problems.According to the form of criminal organization,the public security police duty crimes are divided into: individual duty crimes and group duty crimes.The main categories of crimes of the people's public security police are: torture,violent evidence collection,illegal gun violence,embezzlement,bribery,misappropriation of public funds,abuse of power,favoritism,dereliction of duty,disclosure of state secrets,and infringement of citizens' personal information.The characteristics of the duty crimes of the public security police mainly include: the particularity of the subject of the crime,the multiplicity of the objects of infringement,the group of crimes of knowing the law,and the huge amount of multiple harmfulness.This paper analyzes the duty crimes of the public security police from two aspects: the subjective reasons are the greed and indulgence of human nature,the deviation of the pursuit of value,the lack of the concept of the rule of law,and the weak sense of the rule of law.The leadership takes the lead in committing crimes and the corruption of the upper and lower levels.The objective reasons are the lack of legal system,the lack of legislation,the complex law enforcement environment,the large discretion,the weak judicial control,and the weak supervision mechanism.The legal ways to prevent the public security police duty crime include:First,we will improve the legal system for prevention,improve the corresponding legal system,including clear rules for scientific legislation,fill gaps in the law,refine the strict enforcement of public security police powers,implement the power list system,and strengthen the control of impartial justice.Construct the relevant legal system,obey the law,improve the self-discipline of the public security police;Second,we need to establish a sound supervision system,including improving the system of prior public security police supervision,establishing electronic supervision mechanisms in matters,and establishing a mechanism for monitoring people's complaints afterwards.Third,we need to strengthen education on the rule of law and improve the legal literacy of public security police,including deepening education in integrity and self-discipline,strengthening the construction of team styles,strengthening legal learning,and improving the legal literacy.
