Study On Legal Issues Of Police Duty Crimes In China

The police have a sacred mission to combat crime and protect the people,but in reality there are still a few police officers taking advantage of their positions and functions to engage in illegal and criminal activities.Especially since the reform and opening up,with the rapid development of market economy,the social security situation is becoming increasingly complex,the police duty crime has gradually developed into a social issue that has aroused widespread concern.Compared with the ordinary crime,police duty crime has the characteristics of concealment,reaching,strong,inverse and multiple.The police duty crime social harm is far-reaching,not only the desecration of sacred power entrusted by the state police,damage the legal order,greatly influenced the relationship between the police and the people,the alienation of the belief in the basic social values,but also largely affected the authority and the public security organs of law enforcement credibility,hindered the process of building the rule of law Chinese.How to effectively prevent and curb the police duty crime is imminent.In addition to the introduction and conclusion,this paper is divided into three parts.The first part is the summary of police duty crime.The author focuses on the concept,present situation,characteristics and harm of police duty crime.This paper expounds the concept of duty crime and police duty crime and the relationship between them,points out the present situation of the number of police duty crimes in our country faces the number rising and the wide range of the crime and the subject of crime.It is pointed out that the police duty crime has the characteristics of the special subject,the crime behavior and the position close correlation,the concealment of the criminal procedure,the violence of the crime means;and the police duty crime,police power failure blasphemy law and order and damage relations between the police,destruction of harm to society's basic value.The second part,the representation of the legal problem of the police duty crime in our country.From legal system,police power configuration,the police power supervision mechanism exists the problem of police officers carried on the thorough analysis of the reasons.First,the relevant legal system of our country is not perfect;The second aspect is that the power allocation has the problems of excessive centralization of power,serious power cross,and dislocation of power allocation;Third,the police authority of internal and external supervision ineffective.The third part,the countermeasures to curb the police duty crime.According to the actual situation of police duty crime in our country,this paper puts forward some measures to prevent the improvement of the legal system,the scientific distribution of police power,perfect supervision and control mechanism and so on.
