Research On The Compensation System Of Housing Expropriation On Collective Land

With the development of social economy,the collection of houses on collective land is increasing day by day,because the compensation system for the collection of houses on collective land is not perfect and mature,resulting in social conflicts from time to time.In recent years,the theoretical research on the compensation system of housing expropriation on collective land mainly focuses on: criticizing the low compensation standard of expropriation,the unclear definition of public interest,the imperfect expropriation procedure,and the inadequate protection of the rights and interests of the expropriated.On August 26,2019,the 12 th session of the Standing Committee of the 13 th National People's Congress deliberated and passed the land administration law of the people ' The way defines the content of public interest,stipulates the right of hearing and participation of the collector,and improves the collection procedure.Firstly,this paper affirms the effect of the new land management law,and then analyzes the shortcomings of the new land management law.Among them,the compensation system for housing expropriation on collective land has not been systematized,the protection of the rights and interests of the expropriated is not in place,the definition of "development in pieces" in the public interest is vague,and the relief method for the disputes of expropriation compensation is not perfect.In order to improve the compensation system of housing expropriation on collective land,the author believes that special legislation should be made for the compensation system of housing expropriation on collective land;the examination of public interests should be strictly carried out;the mechanism for protecting the rights and interests of the expropriated should be improved;disputes over compensation for housing expropriation on collective land should be settled and diversified relief methods should be constructed.Finally,the conclusion of this paper is summarized and the future legislation is prospected.
