Research On The Legal System Of Compensation For House Acquisition On Collective Land

With the rapid development of China’s economy,housing expropriation on collective land caused by the acceleration of urbanization and the construction of major projects is more and more frequent.At present,there is not a special law or administrative regulations to regulate this,and there is no unified regulation of housing expropriation activities on collective land,which also brings endless compensation problems.In recent years,the relevant research in the academic circle mainly focuses on the compensation for collective land acquisition,while the related research on the compensation for collective land acquisition,especially the compensation for non operating housing acquisition is relatively small.In view of this,it is of great significance to study and perfect the legal system of housing expropriation compensation on collective land,which is in line with the legal and practical demands,and to protect the legitimate rights and interests of the expropriated.This paper first analyzes the subject and object of the compensation for housing expropriation on collective land,analyzes the legal authority and responsibility of the collector in the compensation for housing expropriation on collective land,as well as the rights and obligations of the expropriated;secondly,through a comprehensive review of the current situation of the compensation system for housing expropriation on collective land,combing the relevant legal provisions and existing in the legal system Secondly,from the aspects of compensation scope,standard,housing value evaluation,illegal building identification,temporary resettlement during the transition period and the relief of the rights of the expropriated,this paper analyzes the current problems in the compensation of housing expropriation on collective land;finally,it puts forward suggestions to improve the compensation system of housing expropriation on collective land.Generally speaking,to improve the legal system of housing expropriation compensation on collective land,we should start from many aspects.Including special legislation to provide normative basis for housing expropriation compensation on collective land;establishing the principles to be followed in compensation from the perspective of market value law;defining the scope of compensation,enriching compensation methods and improving compensation standards;standardizing the current evaluation mechanism to ensure the neutrality of evaluation results;improving compensation procedures and rights relief channels.
