Research On The Evidence Of Smuggling Crimes

The crime of smuggling is a kind of crime which seriously damages the order of socialist market economy and belongs to the economic crime.It not only affects the national tax revenue,but also endangers national security,degrades social morality,and is economically and politically harmful.Compared with ordinary crime cases,smuggling crime cases have the characteristics of complicated evidence system,strong specialization and obvious tendency of intelligent crime.With the advent of the Internet era,the perpetrator of smuggling crime can sign a contract,pay,collect money and other acts only on the Internet.The application of the network makes it easier to hide and destroy criminal evidence,and makes the forms of evidence more diversified and complex.This brings great convenience for criminals to commit crimes and evade criminal responsibility.At the same time,it also brings greater difficulties and challenges for the investigation and evidence collection of smuggling crimes.It is an important problem to be solved to crack down on smuggling crime in the network age that how to build up evidence and change passive attack into active prevention and control according to the characteristics and laws of smuggling crime cases.At the same time,when investigating smuggling cases,the investigators should not only crack down on crimes,but also pay attention to the protection of human rights of criminals.Crimes can be identified only when the evidence is sufficient.This is the inevitable requirement and necessity of a society ruled by law.Proper meaning.This puts forward higher requirements for the collection of evidence in the investigation of smuggling crimes,and is also a difficult point in cracking down on smugglingcrimes.In recent years,with the rapid development of China’s society,economy and international trade,and the popularization of the Internet and electronic technology,smuggling crimes have taken on new characteristics.Smuggling crimes have been on the rise as a whole.At present,scholars and practical circles pay more attention to the identification of smuggling criminal cases,but there is little attention to the evidence of smuggling crime.However,the evidence issue plays an important role in the identification of smuggling criminal cases.Based on this,this paper studies the evidence problem of smuggling crimes through literature analysis and empirical analysis,and divides the structure into five parts:The first part focuses on expounding the characteristics of smuggling crime cases and analyzing the evidences of this type of crime.The second part,mainly appeared in the process of practice in smuggling crime evidence ability and the probative value problems are studied,special emphasis is collected in the administrative authorities and other agencies to investigate evidence ability and electronic data evidence’s probative value problems effectively discussed points out how to solve the problem;In the third part,after summarizing the current situation of cross-border evidence application in smuggling crime cases,the principles of the application of the evidence are expounded,and the existing problems of cross-border evidence application in practice are analyzed and the solutions are proposed.The fourth part studies the application of network investigation technology in smuggling crimes.After the application of network investigation technology in various smuggling crimes,it puts forward some useful Suggestions on the application of network investigation organs.
