Research On The Investigation Mode In Artificial Intelligence Background

With the accumulation of data and the optimization of algorithms,artificial intelligence technology is making people`s lives and work more and more efficient,but it also provides new criminal means and ideas for criminals.Artificial intelligence technology is maliciously used by cybercriminals,seriously jeopardizing people's personal information,privacy,property and personal safety,and even putting threat on social stability and national political and economic security.However,the exclusive feature and complexity of the new cybercrime and the criminal information value behind the massive data bursting in the era of big data had led to the traditional investigation mode unable to adapt to the crime situation in the era of artificial intelligence.The judicial tradition and judicial system of a country determine the choice of an era of investigation mode.The rapidity of data information processing capability and the accuracy of criminal information intelligence research and judgment based on artificial intelligence brought by big data and cloud computing,broadening the ideas and opportunities for the investigation mode,but also bringing challenges to the transformation of the investigation mode.In the sense of legal norms in our country,the investigation initiation procedure is based on the premise of filing a case.This paper studies the connotation and extension of investigation under the background of artificial intelligence from a broad perspective.According to whether the artificial intelligence technology is used in the investigation,the investigation mode is divided into the traditional investigation mode and the artificial intelligence technology-oriented investigation mode.At present,the limitations of traditional investigation of our country are reflected in the following aspects: Firstly,the passive investigation of “criminal act happens and then take investigation actions” can not predict the possible or impending crimes,and can not achieve the purposes of preventing and controlling of new criminals acts;secondly,low investigation efficiency caused by the lag and delay of traditional investigation in collecting evidences and transmitting information.In order to overcome the limitations of the above traditional investigation mode,basing on the artificial intelligence background,this paper studies the transformation of the investigation mode based on the following three aspects: The first is the theoretical basis of the principle of information transformation and the theory of investigative benefit.The principle of information transformation is formed by combining information science with the principle of material exchange.It is formed by the the extension of the principle of material exchange.It is based on the traditional principle of material exchange,but emphasizes the transformation of information in cyberspace.The theory of investigation efficiency is developed from the concept of economics.Intelligent investigation can replace human beings to do repeated and simple analysis and calculations,which can alleviate the current shortage of police force and improve police force in China,thus further improving the investigation efficiency;The second is the technical foundation,including natural language processing,computer vision and big data system and cloud computing technologies.The “Intelligence Brain Public Security Case System” and “Blinking Big Platform Technology” developed by these technologies are important tools for preventing and combating crimes in the work of investigation agencies;The third is the foundation of practice,including the data-based ecology of crime and the creation of an intelligent auxiliary system for criminal cases.In the era of big data,although data information is the object of crime or the tool used,according to the principle of traces and information transformation,data also records the every move of criminals.Data is the real ecosystem of crimes.The nation`s first criminal case intelligent auxiliary case handling system embeds modern technologies such as big data,could computing and artificial intelligence into the criminal case handing process,providing a full range of intelligent case handling assistance for case handlers.At present,through the application of artificial intelligence in the field of investigation,this paper studies the influence of artificial intelligence on the investigation mode,which is embodied in the investigation thinkings,investigation concepts and the applications form of intelligent investigation technology.Investigation thinking includes the following three levels of content: the first is investigation related thinking which changes from asking "why" to "what is",focusing on finding related people or related objects and intelligently mining data or correlation behind some things;the second is investigation of holistic thinking,which is mainly reflected in the collection of comprehensive evidence of "people,things,time,space,and traces" that constitute the elements of crime;in the joint investigations of serial cases and crossregional cases;the third is investigation predictive thinking,which includes predictions of criminals,predictions of criminal cases,and predictions of overall trends in crime.The investigation concepts in the background of artificial intelligence should be the combination of retrospective investigation and predictive investigation and the concept of “from supply to certificate” to “from certificate to supply”.In the applications of intelligent investigation technology,it mainly includes: using algorithms to predict crime locations,predicting potential criminals through machine learning,artificial intelligence lie detectors to assist in trials,and using face contrast technology to find criminal suspects.Even though the development of artificial intelligence technology in the era of big data makes the investigation work more and more inclined to network investigation,the data that the investigation organization can use is very large,but many data are scattered in different parts,and some departments prevent data leakage for their own benefit.The status of refusing data sharing and the current immature state of data secrecy and sharing mechanisms have led to data barriers such as data format differences and inconsistent standards between different departments.This is one of the dilemmas of the investigation mode in the background of artificial intelligence.Then,technological innovations have made the anti-counterfeiting technology of electronic data constantly changing.In the absence of a specialized technical team,it is very difficult for most judicial personnel with legal background to deal with technical problems,resulting in a lack of authenticity of data.Lastly,the right to personal information represented by private rights is weakly protected in the intelligent era due to the lack of related laws and regulations,such as the lack of the ? Personal Information Protection Act?,the lack of the protection of personal information rights by the Criminal Procedure Law,and the exemption limits of information are ambiguous in the process of collecting and using personal information by investigation organization,so that the right to personal information appears to be vulnerable in the face of public rights represented by artificial intelligence technology.In response to the above problems,this paper proposes constructive suggestions from three aspects.The first aspect is the procedural safeguard system,establishing the data trace system of artificial intelligence investigation decision-making and the accountability system for clarifying the mistakes of artificial intelligence decisionmaking.The former guarantees the integrity of the data transformation process,while the latter limits the abuse of artificial intelligence technology by the investigation organization.The second aspect is the rights protection system.Firstly,under the black box effect of the algorithm,the party is given the right to dissent,and at the same time,the "expert assistant system" is introduced to open a path for the suspect to fully and effectively use the right of dissent.Secondly,based on the principle of individual participation and the principle of proportionality,it will improve the legal system of personal information protection in our country.The third aspect is the integration of data and human resources.The first is to unify the data sharing mechanism between industries in the top departments of all walks of life,and to clarify the types of data that open to the investigation organization in various industries.Secondly,according to the different tasks of the investigation organization,different application functions,such as data collision application,information mining,evidence collection and fixation,crime prediction and other application functions,are studied on the basis of massive data sources.Finally,in terms of personnel training,it is often said that “the best players and the best judicial investigators are not people or machines in the future,but a team of people and machines”.Therefore,this paper advocates that the construction of a new type of investigation mode must promote cross-professional cooperation and encouraging the investigation of contractual training between institutions and universities,universities and universities.In addition to the traditional physical investigation space,this paper seeks to explore the modes and methods of intelligent investigation to overcome the shortcomings of the traditional investigation mode and adapt to the background of the rapid development of artificial intelligence in the modern era.The traditional investigation mode has paid more attention to the collection and fixation of evidence under the line and the arrest of criminal suspects offline.The characteristics of passive,causal and unitary manifestations of this type of investigation mode in the background of the new era have become one of the boosters for the transformation of the investigation mode.In the artificial intelligence background,a data space corresponding to the physical space is created,and each of us will leave data traces in every move in this data space.As far as the investigation organs are concerned,on the one hand,this data space has become a new field of investigation by the investigation organization.On the other hand,the new technology derived from this data space has provided new investigation methods and means for the investigation organization.Based on this logic,this paper puts forward the theme of "exploration of the investigation mode under the background of artificial intelligence",studies the feasibility of the transformation of the investigation mode under the background of the new era,and analyzes the changes caused by artificial intelligence to all aspects of investigation.In summary,the innovations of this paper are as follows: First,breaking the concept of investigation in the sense of traditional legal norms,that is,the subject of investigation,start-up time,measures,etc.are strictly restricted.The investigation of this paper is a kind of investigation in a broad sense.It not only includes statutory investigation,but also the initial investigation and predictive investigation before the case are also the scope of this paper.The second is to study and summarize the cornerstone of exploring the investigation mode under the background of artificial intelligence.At present,there are only a handful of academic researches on the combination of artificial intelligence and investigation in academia.The articles on artificial intelligence and investigation scatters in the overwhelming news reports.After reading a lot of domestic and foreign news reports,articles,academic forum reports and a small amount of literature materials,this paper summarizes the foundations of exploring investigation model in the background of artificial intelligence from the three aspects of theory,technology and practice.The third is to propose the construction of relevant systems for the dilemma encountered in the investigation mode under the background of artificial intelligence,such as Data Audit Trail technology,provenance of the data technology,giving party the right to dissent raised by the effect of algorithm black box.
