Artificial intelligence is developing rapidly,the advent of the age of artificial intelligence brings risks to the protection of personal information.The more information entered,the more intelligent artificial intelligence.Therefore,the development of artificial intelligence will inevitably lead to the larger collection and use of personal information.Artificial intelligence products are everywhere,the opacity of the algorithm threats the protection of personal information.The collection of information by artificial intelligence is concealed,and the analysis and processing of information is highly efficient,its outstanding feature is the wide application of biometric information.The Civil Code does not stipulate personal information as a specific right,the Personal Information Protection Law(draft)has been published,which defines personal information as legal interests,it is soliciting opinions and has not yet been finalized.The main problems of personal information protection are as follows: Lacking special laws for the protection of personal information,and the relevant protection provisions are scattered in many laws and regulations,so the personal information cannot be systematically protected.The principle of informed consent is improperly applied in practice.The importance of biometric information is not fully reflected in legal regulations.People do not have strong awareness to protect personal information,and the strength of individuals and information processors is uneven.These problems have become obstacles to personal information protection in this day.In response to the above questions,this article analyzes the characteristics of the use and collection of personal information by artificial intelligence,learns from the US and EU,and considers the situation in our country,proposes the following strategies:Using the right protection mode to provide direct protection for Personal Sensitive Information,and improve the tort liability provisions in this respect.Taking industry self-discipline as a supplement to legal protection.Combining algorithms and legislation to inform the application of consent rules.Finally,adopting special legislation to protect biometric information.Also,it is necessary to take the development of artificial intelligence into account,and reserve development space for artificial intelligence.
