Marriage-type Human Trafficking Crime Research

The geographical connection between China and Vietnam,the border language and culture are the same,the exchanges are increasingly frequent,and the cases of transnational trafficking in women continue to grow.The crime of trafficking in women not only violates the personal rights of the women who are trafficked,but also seriously endangers social security.Although China and Vietnam have held several joint crackdowns,under the influence of many factors,such criminal activities have increased and are not effectively curbed.The cases of trafficking in women between China and Vietnam are mostly marital-type trafficking.This is different from the sexual exploitation of other regions.Therefore,this article searches for the case of trafficking in Vietnamese women on the “Chinese Judgment Document Network” to find out the marriage.The type of trafficking is summarized and analyzed,describing the social background and main characteristics of the occurrence,and on this basis,find out the reasons for its occurrence,and try to propose reasonable and operable prevention measures.The occurrence of marital trafficking in Vietnamese women's criminal activities is the result of the interaction of various social factors.First of all,the idea of a long-lived preference for the male and the ancestors at the buying end led to a serious gender imbalance,and a large number of “married surplus populations” appeared in the urban-rural gap.These older unmarried men are excluded from the marriage market and create a huge demand market.Secondly,in terms of victims,Vietnamese women are under the double poverty of gender poverty and economic poverty.They are eager to flee Vietnam to change their own family and even the family's destiny.They have a strong desire for outflow,under the preaching of traffickers and their own imagination."Paradise is very far away,China is very close" has become the consensus of Vietnamese women with the willingness to flow out.The group of offenders is mostly marginalized and buying community farmers.They are familiar with the characteristics of the buying community and Vietnamese women.They have a clear division of labor and make full use of their own network resources to form a chain of trafficking from Vietnam or the border to the Chinese mainland.The use of “anomie theory” and “Routine Activity Theory” can explain why buyers buy and sell Vietnamese women who are being trafficked and marital trafficking in Vietnamese women.It is a legitimate goal of the purchaser to marry a wife,but because of the emergence of “high-priced bride price” and the unfair channel of legal cross-border marriage,it is impossible to use legal means to complete its legal goal,and instead buy the Vietnamese women who have been trafficked,behavior".Because there is a huge demand on the buying side,it will stimulate the criminal motive of the trafficker.The theory of Routine Activity believes that the occurrence of a crime requires not only criminals with criminal motives,but also appropriate criminal goals and lack of effective supervision.The economic benefits of trafficking in Vietnamese women are high,and Vietnamese women with strong willingness to outflow become suitable criminal targets because of their vulnerable status.The criminalization of marriage-type trafficking in women and the traditional introduction of marriage are vague,the formal crackdown is not enough,and the lack of the lack of social monitoring caused by social condemnation.Therefore,marital trafficking in women's criminal activities is a product of social relations as a link between criminals,victims and buyers.In the last part of the article,the concept of developmental prevention is used to propose preventive measures.The main way of prevention is to “sparse” rather than “block”.On the one hand,we should reduce the demand of the buyer's market by changing the gender ratio imbalance;on the other hand,we should change the bride price.To the materialized meaning of women,change the status quo of "high price bride price",and establish a legal transnational marriage mechanism,so that the buyer has the legal means to complete its legal goals.Finally,for the traffickers,from the perspective of reducing the incentives to stimulate their crimes,reducing the benefits of crime,increase the intensity of crackdowns,and strengthen effective monitoring,comprehensive management of marital trafficking in Vietnamese women's criminal activities.
