On The Implementation And Improvement Of The Supervision Work Of Community Correction Objects

Since the pilot in 2003,community corrections in China have lasted for 15 years.Although there has not been a special "Community Correction Law",the development of community corrections has gone through a process of change from nothing to extensive to fine.Since the promulgation of the “Community Correction Implementation Measures” in 2012,community corrections have been developed rapidly.A large number of practical experiences have been accumulated in various places,and relevant systems have also been improved.Especially when the community correction system was historically written into the "Criminal Law of the People's Republic of China" and "The Criminal Procedure Law of the People's Republic of China" and other important laws,China's community correction practice has ushered in a rapid development.However,it should not be overlooked that while the community correction system is advancing by leaps and bounds,the implementation of community correction penalties faces many unreasonable and uncoordinated problems.As one of the three major tasks of community correction,the supervision work is accompanied by the changes and innovations of the community correction system in China.In the community correction penalty execution system,supervision isextremely important,and it is an important driving force for achieving the goal of community correction work.This paper takes the implementation of community correction and supervision work as the entry point.Through the combination of various real cases and work data,this paper deeply explores the dilemmas and problems in the community correction and supervision work in China.At the same time,through analysis and summary of relevant practical data,we can summarize various problems in the supervision work and reflect on the shortcomings of the community correction penalty execution system,and provide targeted suggestions for improving the community correction supervision system in China.This paper makes full use of literature research methods,observation methods,comparative analysis methods and other research methods,supplemented by reading all kinds of archival materials,and successfully completed the research and discussion of community correction and supervision work.The written structure of this paper includes the following three chapters:The first chapter mainly combines various data cases in the supervision work of Jiading District Judicial Bureau in recent years,comprehensively analyzes the current situation of the implementation of community correction supervision work in this jurisdiction,and comprehensively summarizes the rich experience and work characteristics of community correction supervision work for many years.It introduces in detail the main contents and methods of the “seven major categories” of community correction and supervision work in Jiading District: daily supervision,enforcement of prohibition orders,electronic monitoring,mobile supervision,classification management,risk assessment,and emergency response.The second chapter deeply analyzes the dilemmas and problems in the community correction supervision work in China,which is mainly characterized by the lack of support from the top legal system;the weakening the correction of punishment function;the regional imbalance,the unreasonable allocation of supervision work resources;the imperfection of supervision and management measures and problems and so on;Through the penal enforcement practiceperspective to analyze the causes of problems in the supervision work one by one.The third chapter combines various cases and data and uses literature research methods,observation methods and other research methods to presuppose the author's actual work foundation,and initially puts forward some ideas and suggestions for standardizing China's community correction supervision work: Correct the construction of the legal system and actively construct a community-corrected legal system for criminal integration.On the other hand,we will continue to improve the legislation on community correction related legal systems,and gradually promote the implementation and improvement of the community correction system;second,improve the construction of the community correction penalty system,and ensure the implementation of the community correction system;The implementation of the regulatory enforcement system will further improve the practical effectiveness of the evaluation and punishment system and actively introduce the implementation of the supervision and correction project;Fourth,the effective involvement of social forces,the effective participation of social work organizations,volunteer teams and other social forces will help promote the improvement of supervision work of community corrections.In the conclusion part,through the above explanation and analysis,the author places certain expectations on the upcoming Community Correction Law.I hope that the upper-level departments can base themselves on the reality of the country and appropriately learn from the advanced experience of foreign countries,and formulate a high-quality law to meet the various needs of community correction penalty execution.Finally,resolutely break the implementation barriers of different departments and use this opportunity to form a unified and orderly and effective regulatory and correction legal system to promote the healthy development of the community correction system in China.
