Reform And Improvement Of China’s Community Correction System

With the continuous development of human civilization, people’s awareness of their rights continues to awaken. The trend of penalty is also from barbarism to civilization, the emotional to rational. Community corrections emerged by following the historical trend. Community corrections refer to a kind of penalty enforcement activity that criminals who meet the conditions of community correction are live in the community, specialized state organs correct their criminal psychology and behavioral abuse with the assistance of social groups, civil organizations and community volunteers, facilitating them smoothly return to society.As the penalty enforcement activity in the community, the aim is to avoid the drawbacks of the sentence of imprisonment, make full use of social resources and make great efforts to promote the re-socialization of criminals. It has a great importance of reducing the prison execution costs to relieve the pressure of prison and promote social stability. From the early20th century, local pilots have become to comprehensive trial basis. Through years of pilot work, many places have been exploring the community correction system which is in line with China’s national conditions, and have accumulated a lot of useful experience in the practice and achieve some success. But as far as the situation concerned, the level of Community Correction is still relatively in the lower level, and still has large gaps to developed countries. Community correction system needs to further deepen and improve. Therefore, it should deepen the study of the Community Correction in theatrical and practical and provide some reasonable suggestions. Based on this, I chose this thesis topic of Community Correction and able to do my modest.This thesis includes3parts besides introduction and conclusion.The first part presents the theoretical background of community correction, including the concept of community correction, its characteristics and theoretical basis etc.The second part is mainly about the practice of China’s community correction. Its achievement is summarized on the basis of detailed introduction of Beijing and Jiangsu’s experimental practice. The achievements include construction of its basic framework and better social and legal effects. But, the problems in its practice are liable to rise, such as lack of people’s understanding, legislative lagging behind. What’s more, the development of community correction is severely restrained because of the conflict between its present executive context and the existing law, the problems in applicable objects, the limitations of the present community correction mode as well as the backwardness of community construction.The third part introduces the improvement of the community correction system. Measures of its improvement are put forward based on problems that has been found or may arise in practice.
