Research On The Registration Exemption System Of Mobile Vendors In China

Mobile vendors have a long history in China.They can not only facilitate people's lives,but also solve part of employment.At the same time,the vendors also brought problems,such as affecting the appearance of the city and obstructing traffic.These troubles make the vendors often face the risk of being banned by urban management on the premise that China does not explicitly prohibit the stalls,and being banned often causes the vendors losing their sources of life.This kind of survival dilemma makes the contradiction between the vendors and the urban management constantly,and even bloodshed often occurs.It still has the necessity of the existence of mobile vendors,but they are difficult to survive.This will not only increase social unrest,but also against the overall development of the social economy.The reason for this dilemma is that China's current mobile vendor registration system still has the following problems: the public law function of the commercial registration system is over-expanded,the citizen's business right is not fully protected,the status of the mobile vendor is not given,and the full implementation of mandatory registration.The reason why these problems still exist is because China is still affected by the cultural background of “agriculture and trade suppression” in ancient times,the planned economic system implemented in the last century,and the concept of regulated government,and it is still not unified in commercial legislation.After learning from the useful experience of relevant legislation and management systems outside the territory,we can know that in order to solve the problem of the survival of mobile vendors and the problems of urban management,we should establish a system of exemption for mobile vendors in China.The establishment of this system is based on the policy foundations of the reform and opening up of economic policies,the promotion of entrepreneurial market policies and the reform of the commercial registration system.It is also a modest introduction of arbitrary registration on the premise of maintaining compulsory registration in general.The establishment of the system should affirm the citizen's right to operate in the constitution,establish the commercial status of the mobile vendors in the legislation,and formulate a unified commercial registration law.While ensuring the right to subsistence of mobile vendors,the city management problem brought by vendors is solved through the filing and registration system and the classification of stalls.In terms of food hygiene management,in order to protect the legitimate interests of third parties,strict management is still required.
