When the network appears,online pornography also comes along,like a shadow.In China,the government and the public have always attached great importance to the issue of online pornography,and they have taken heavy blows.Although it has achieved good results,with the continuous updating of network technology,it can be found that online pornography is around us,and its deceptive,concealed,and deceptive nature has become more powerful,greatly increasing the difficulty of supervision.The network environment is intricate and complicated.We don't have enough scientific and systematic understanding of online pornography.We still stay on the argument that “pornography” has “poisonous”,and list some online statements that are “involved in yellow” but are justified..It is undeniable that China's regulation of online pornography is still in its infancy,and it still faces enormous pressure and new challenges.In this social context,after researching and discussing the necessity and deficiencies of online pornographic regulation,we will give targeted improvement suggestions.This paper summarizes five parts: The first part is the institutional framework and legal principles for regulating online pornography.It mainly analyzes the protected objects,legal basis,main measures and boundary scope of the system.It also analyzes the jurisprudential basis of online pornography.The first question,"What is Internet pornography," is elaborated.After the explanation,the online pornographic speech is divided into legitimate use and improper use,profit and non-profit according to its external manifestation and intrinsic purpose.The second part is the practical difficulties encountered by the government departments in the process of managing and regulating online pornographic speech.In the first section of the second part,we clearly analyze the contradictory situation of online pornography for the purpose of proper use in the network purification activities,and point out how to define the relationship between pornography,sexual cues and artistic creation.The second section points out the difference between online pornographic remarks for non-profit-making purposes such as revenge and defamatory and online pornographic speech for profit-making purposes,and the identification of non-profit-making online pornographic speech is more difficult,more concealed,more harmful and The victim does not have a set of effective protective measures.The third section points out the huge transnational black industry chain behind the online pornographic speech for profit,and why the black industry chain can exist.The third part is to introduce three existing models for the mainstream of online pornographic regulation.It compares and protects the creative freedom model with the “general common person” model,and then elaborates the model of protecting the interests of specific groups and the regional cooperation model.On the basis of clarifying the reasons for these three models,it points out the shortcomings of these three models.Where,and these three models can be used for reference to China's current national conditions.The fourth part is the analysis of the role that government,network service providers,and network consumers should play in the regulation of online pornography.The fifth part analyzes the limitations of the existing online pornographic regulation system in our country,and combines the multi-regulation theory proposed in the fourth part to carry out specific institutional reform of the existing regulatory model.First of all,"network neutrality" is the guiding principle of the regulatory system.Secondly,the legislation "prescribes the right medicine" requires the government to give administrative counterparts the right to remedy after administrative law enforcement,and then proposes a network service provider.And advice from web users on how to regulate online pornography.
