Since the reform and opening up,after years of efforts,China's economic development has made remarkable achievements.Under the socialist economic system,various economic forms have been greatly developed in their respective fields,especially those in the main body of market economy.With the arrival of the credit society,modern enterprise production and management process in the use of funds,more and more favored in the long-term payment and short-term financing of the letter of credit.Especially in the last two years,the development of the real economy in our country has promoted the prosperity of various enterprises,and also made the amount of the letter of credit on the letter of credit increasing day by day.On the basis of this situation,many scholars and people in the field are exploring the issue of the asset securitization of the letter of credit.It is necessary and important for the development of letter of credit asset securitization.Credit asset securitization is not only able to expand direct financing channels for enterprises of all types,but also alleviate the holding of credit assets of the enterprises to a great extent,especially the problem of higher financing difficulties of small and medium-sized enterprises,financing costs.Of course,in order to develop into a benign direction,we must adopt standardized and transparent operations to effectively avoid all kinds of risks related to the use of funds.Because the letter of credit asset securitization is a relatively new field,therefore,the legal research of the letter of credit and legislation in our country are relatively deficient.Even in the Supreme Court,the legalization of L / C is far from enough to meet the reality of China's trade boom.From the long-term and development point of view,any new things develop to a certain stage,all of them need the law to escort them.Therefore,the legal research on the securitization of letters of credit is the trend of the times.It is very necessary for us to use foreign legislation and Practice for reference to improve the relevant laws of our country's letter of credit.In the future,I will further clarify the legal nature of the letter of credit securitization,and establish the principle of application of the law,so as to promote relevant legislation in this field.In the short term,in the relevant domestic laws,the increase and revision of the terms of the letter of credit is in line with the latest requirements of our country's letter of credit.This paper is based on the credit asset securitization model and comparative analysis,the legal obstacles of credit asset securitization,finally on the basis of the previous two proposed consummates our country credit asset securitization advice.
