Research On The Copyright Protection Of WeChat Works

WeChat has attracted much attention since it was launched in 2011.At present,with 7.67 billion downloads and more than 1 billion users,WeChat has become the leading mobile device communication software.Meanwhile,the WeChat personal account and WeChat official account also bring a problem to be solved urgently for copyright protection of works in WeChat platform.Although it is urgent to solve the existing infringement chaos,the copyright protection of WeChat platform works has not yet formed an independent and complete research system.In the Internet plus era,whether WeChat personal or WeChat official account for copyright copy and forwarding of various works,whether copyright infringement is made,how to protect copyright of WeChat platform works,how to balance the efficient propagation speed brought by Internet and the relationship between copyright protection of works,is worth paying attention to and in-depth study.The works published on WeChat are often short in length,and many of them are improvisational.Accurate originality judgment is the key to analyze whether they enjoy copyright.In practice,there are many disputes about whether the reproduction,forwarding and deduction of WeChat works can be justified by reasonable use and legal permission.Under the background of the great development of communication technology,the particularity of the copyright protection of WeChat works deserves our careful study and consideration.WeChat works copyright is a form of expression of copyright networking,which not only has the general characteristics of copyright,but also has the attribute characteristics brought by WeChat platform itself.Because of the attribute characteristics of WeChat platform itself,the copyright infringement cases of WeChat platform works are more complex and more difficult to hear than those of ordinary works.Therefore,this paper mainly studies the copyright protection of WeChat works from the following four aspects:First of all,starting from the current situation of copyright infringement of WeChat works,this paper analyzes the characteristics of WeChat works and types of infringement,such as WeChat publishing,WeChat forwarding and WeChat works deduction.Find out the characteristics of the copyright infringement of WeChat works,such as the immediacy and diversity of the infringement and the extensiveness and concealment of the infringer.Secondly,it summarizes the existing problems of WeChat copyright protection,such as the imperfection of Internet copyright protection laws,the lack of special legislative provisions in legislation,the defects of reasonable use system mode,and the need to improve the legal licensing system;the difficulties in obtaining and retaining evidence in judicial practice,the low cost of infringement,the high cost of safeguarding rights,and the difficulty in forming a unified damages Standards: in terms of WeChat platform's own characteristics,the dilemma of safeguarding rights caused by the interest driven by the network platform industry and the weak supervision of WeChat platform.Thirdly,we can learn from the copyright protection of foreign WeChat platform works,such as the Enlightenment of SOPA bill in the United States on the copyright protection of WeChat works and the reference of public law mode of French network copyright protection system.Finally,it studies the copyright protection path of WeChat works.In terms of legislation,we should improve the legal protection system of Internet copyright,clarify the scope of reasonable use of WeChat works,and strictly enforce the legal licensing system;in terms of judicial practice,we should unblock the channels for safeguarding rights,improve the compensation elements,and build a multi governance model;in terms of WeChat platform,we should strengthen the supervision of WeChat platform,preset the copyright protection mechanism,and improve WeChat public platform services.The terms of the agreement,the construction of WeChat copyright collective management organization,and the increase of work duplicate checking mechanism.
