Animal Objectivity Theoretical Research Of Law—Pet Perspective

The Chinese civilization has a long history.Pets are the mostclosely related animals to human beings on earth.With the development of economy and the progress of The Times,pets have entered into the lives of thousands of people and served as messengers to enrich people's spiritual world.More and more pets are called family members.With the development of China's economy and the continuous improvement of people's living standard,more and more people begin to pay attention to the prosperity of the spiritual world.In modern society,the relationship between pets and human beings has become increasingly close,which enriches the spiritual world of the people and brings closer the harmonious coexistence between human beings and nature.Since the impergium,there have been records of pet keeping in China,from hunting companions to modern family companions.Pets are also playing an important role in modern society,such as guide dogs,drug-detecting dogs and rescue dogs.However,at the present stage,China has not issued special laws and regulations related to pet protection,there is no clear about the rights and obligations of keeping pets,the responsibility of keeping pets is not clear,and the status of pets is only placed in the category of ordinary things.With the continuous increase in the number of pets,the social problems related to pets are also increasing gradually,and many social contradictions caused by pets are in urgent need of a special law and regulations to solve them.At present,the establishment and improvement of pet protection related laws and regulations,the establishment of animal case system to improve the pet protection mechanism has been the trend of social development.This paper first introduces the historical origin of the animal case system,the historical development of pets in the Roman period and the special status of pets given by the Romans,and expounds and analyzes the current mainstream ideas and feasibility of animal protection.This paper puts forward the idea and viewpoint of establishing animal case system under the general provisions of civil law.Then it discusses the current status and reflection of Chinese mainland's pet protection legislation,and analyzes the laws and regulations on pet protection in foreign countries and Hong Kong,Macao and Taiwan.According to China's national conditions and social needs,it finally analyzes the deficiencies of China's pet protection,and puts forward specific legal measures to establish the animal case system for China's pet protection.Based on the basic national conditions of Chinese society,this paper aims to improve the status of domestic pets by establishing the animal case system,so that domestic pets can be protected at the highest level.This paper puts forward the legislative proposal on pet protection and the concrete measures to implement the law.In the civil law,the exclusive legal definition of animal property is defined,and special legislation is made to protect pets.
