The report to the 19 th national congress of the communist party of China pointed out: "we will strengthen the social security system and ensure that housing is for living,not for speculating.In 2016,the general office of the state council clearly pointed out in the opinions on accelerating the cultivation and development of housing rental market that financial institutions should be encouraged to provide financial support to housing rental enterprises in accordance with the principles of law and compliance,controllable risks and sustainable business.It can be seen that China is now using financial means to promote the construction of housing rental market.At present,the two of the most important means of financial support,respectively,based on real estate investment trust financing model for rental housing developers and financial institutions alone or with rent the apartment to the lessee to provide loans,because our country is in the primary stage,in terms of housing lease finance did not form a complete set of perfect legal system,not be regulation is easy to cause legal risk and financial risk.Therefore,it is necessary to study the legal supervision system of housing rental finance.More than China's current legal regulation of housing lease finance to macro,the related existing law regulation,but the rental housing,such as the United States financial market developed countries have set up corresponding legislation,and the responsibility of the regulators is more clear,draw lessons from foreign legislation experiences,China can be found on the basis of other countries is suitable for the experience of our country.This article mainly divides into four parts: the first,studies our country legal system and housing rental housing,housing lease finance leasing the concept of legal system of financial regulation and supervision of the reality demand,from the housing lease finance regulation law system in China is clearly based on the connotation and the necessity of establish a perfect legal supervision system,provideda basis for the next.Second,it introduces and analyzes the development status and legal supervision system of housing rental finance in foreign countries,compares the current situation of China through relevant experience of foreign countries,and puts forward the reference target and enlightenment for the legal supervision of housing rental finance in China.Thirdly,it introduces the current situation of the legal supervision of housing rental finance in China,and through the analysis of the legal system of housing rental finance market,it gradually goes deeper into the current situation of the legal system of housing rental finance in China and the problems that need to be improved.Fourth,clear legal relations and from four aspects,put forward Suggestions for the perfection of our country housing lease finance regulation law,and from the housing lease finance main body access and operation regulation,housing lease finance regulatory legal responsibility,the information disclosure system of legal regulation,housing lease finance to improve protection of the rights and interests of consumers.
