Study On The Legal Mechanism Of "River Chief System"

As a kind of innovative system,“River Chief System” tries to resolve the predicament existing in the current water resource management of our country,and its appearance has brought about the change to the concept of water environment treatment in our country,it also changes the original water resource management system from the legal mechanism.The research on the legal mechanism of the new management mode of “River Chief System” can promote the improvement of water resources management mode.From the perspective of policy and legislation,this paper explores the origin and related legislative basis of “River Chief System”,and discusses the implementation subject and content of “River Chief System” according to the policy and legislative content,that is,the specific provisions of river chief 's power and responsibility.Expounds the impact and change of “River Chief System” to the concept of water environmental treatment in China by using the concept of holistic governance,the emergence of “River Chief System” is to solve the phenomenon of administrative fragmentation of rivers and lakes in China,in essence,it is to transform the interests of departments into the overall interests of the government,from decentralization to concentration,and to achieve the overall governance in law.Combined with the policy,legislation and local legislative practice of “River Chief System”,this paper conducts an integrated study on the relevant legal provisions of “River Chief System”,and summarizes the legal mechanism contained in “River Chief System”,finally,it comes to the three levels of legal mechanism,namely,the coordination mechanism,the assessment and accountability mechanism and the supervision mechanism.Combines with the difficulties in the operation of “River Chief System” in Jiangsu,Guizhou and Hunan provinces,the existing problems are summarized as follows: the river chiefshave too much authority and improper exercise,the fuzzy subject of assessment and accountability,and the absence of administrative supervision.In view of the existing legal mechanism of “River Chief System”,puts forward the corresponding improvement recommendations respectively from the coordination mechanism,assessment and accountability mechanism and supervision mechanism.In terms of coordination mechanism,should appropriately decentralize the powers of river chiefs and regulate the exercise of their administrative licensing powers;in terms of assessment and accountability mechanism,should build a perfect governance responsibility system and strengthen the subject,object and content of assessment and accountability;in terms of supervision mechanism,the establishment of supervisory bodies is centered on internal administrative organs and specialized organs.
