| As the head of the Hong Kong Special Administrative Region,the chief executive has an important responsibility for the overall implementation of the "one country,two systems" policy and the Hong Kong Basic Law.The legal responsibility of the chief executive is stipulated in Article 43 of Chapter IV of the basic law of Hong Kong.The content is that the chief executive is the head of the Hong Kong SAR and shall be responsible to the Central People’s Government in accordance with the requirements of the basic law.However,the chief executive’s responsibility to the central government is not clearly explained or explained in the basic law.In practice,the chief executive’s responsibility for the Central People’s government should not only follow the provisions of the basic law,but also rely on relevant working practices.It can be seen that there are many gaps in the content of the chief executive’s responsibility in the basic law.If the chief executive’s responsibility for the Central People’s government depends on the working practice for a long time,it will lead to the lack of legal norms for this "responsible" relationship,as well as the lack of relevant stability and effective operation mechanism to guide it,which is not conducive to the exercise of the central government’s overall governance power over the Hong Kong SAR Supervisory power.Therefore,the author hopes that through the research of this paper,on the premise of clarifying the constitutional basis and theoretical basis of the chief executive’s responsibility to the Central People’s government,the author can sort out the legal norms and practical practices of the chief executive’s responsibility to the Central People’s government,and put forward to improve the chief executive’s responsibility on the basis of the current basic law The Central People’s government is responsible for the conception and suggestions of relevant mechanisms,strengthening the central supervision over the Hong Kong SAR,and promoting the further development of the relationship between the Central People’s government and the chief executive. |
