On The Confirmation Of The Guaranty Effect Of The Juveniles' Property

In recent years,In private lending cases and bank credit cases,mortgages,such as borrowing from a parent's property under the name of a minors,are unceasingly emerging.However,in judicial practice,There is no unified standard and legal basis for the determination of the effect of the mortgage on the property of the parents under the name of the minors.Resulting in the different co contracting embarrassing situation.This is not only detrimental to the image of justice and fairness,but also is not conducive to social harmony and stability.Therefore,this paper intends to further explore the status and problems of the effectiveness of the guaranty of the minors' property.With a view to clarifying the relevant legal relationship,I hope to put forward some specific suggestions for the identification of minor property security,so as to provide references for relevant legal theory research and judicial practice.
