Research On The Legal Protection Of Teachers' Rights In Private Primary And Secondary Schools

Since the 1980 s,China's private education has undergone a role change from supplementary public education to enriching the form of education.At present,private education has entered a period of rapid development,and its degree of rule of law is also increasing.At present,private education has entered a period of rapid development,and its degree of rule of law is also increasing.However,as China's private education development has not yet fully matured,many existing problems in this area need to be resolved,including private school property rights,the nature of the school's legal person,school management,and the protection of the rights of students and teachers.Among them,the protection of private primary and secondary school teachers' rights is particularly prominent,and it is a basic issue that must be paid attention to in the development of private education.Teachers are the foundation of establishing a school.Private primary and secondary school teachers carry the important responsibilities of primary and secondary education.Protecting the rights of teachers is the key to the healthy development of private primary and secondary schools.This article starts from the legal basis of the protection of private primary and secondary school teachers' rights,and starts from the status quo of the protection of teacher rights.Taking the problem as the guide,it further analyzes the protection of private primary and secondary school teachers' rights in terms of legislation,law enforcement,legal relief and teachers' legal awareness.The pain points and difficulties,at the same time,combined with the current situation in the field of private education,put forward practical solutions.This article is divided into four parts:The first chapter is an overview of the protection of the rights of private elementary and middle school teachers.This chapter first introduces the development of private education in China,the current development of private primary and secondary schools and their teachers;second,it clarifies the legal basis for theprotection of private primary and secondary school teachers' rights,that is,the basic rights as workers and the professional rights as teachers Finally,we will introduce the current situation of the protection of the rights of private elementary and middle school teachers in some areas of China,aiming to reveal the necessity of strengthening the protection of the rights of private elementary and middle school teachers.The second chapter is the investigation and analysis of the protection of the rights of private elementary and middle school teachers.The author first launched an investigation in Kunming,Yunnan Province.Through questionnaire surveys and field visits,it was found that there are still a large number of violations of the rights of private primary and secondary school teachers.Based on the survey results,it summarizes many problems in the protection of the rights of private primary and secondary school teachers in Kunming.The third chapter is the reason why it is difficult to protect the rights of teachers in primary and secondary schools in Kunming.The causes of the dilemma are analyzed one by one from the four levels of legislation,law enforcement,judicial and legal awareness.There are several aspects: one is the lack of legislation and the incomplete legislation;the second is the lack of supervision by law enforcement departments and the unscientific means of law enforcement;the third is the law Relief channels are not perfect and smooth;Fourth,teachers' rights protection is weak.The fourth chapter is the countermeasures of the dilemma of protecting the rights of private elementary and middle school teachers.Based on the summary of the protection of the rights of private elementary and middle school teachers in some areas of the country,combined with the survey and analysis of Kunming City,supplemented by reading a large number of relevant documents,the following corresponding solutions are proposed: perfect the local legal system and ensure the system fit;Clarify the functions and powers of the law enforcement department,standardize the law enforcement;broaden the legal remedy channels and improve the legal remedy procedures;improve the legal awareness of school teachers and reduce the infringement of teachers 'rights,with a view to solving the current dilemma of the protection of the rights of private primary and secondary school teachers through the above countermeasures.
