Research On The Inheritance Of Virtual Property In Online Games

The development of Internet technology promotes the prosperity of online game industry,and then gives birth to the new thing of virtual property.At the same time,the succession of virtual property in online games has been paid more and more attention with the increase of cases in practice.But unfortunately,although the civil code affirms the legal status of the virtual property of online games,the succession system matching it is not perfect enough.First of all,according to the provisions of the Civil Code,combined with the main theories of the theoretical circle,this paper briefly summarizes the meaning,main types,characteristics and right attributes of the virtual property of online games,on the basis of defining the basic ownership of virtual property in online games,the author discusses the necessity of perfecting its inheritance system.Secondly,after comparing the inheritance status of virtual property of online games inside and outside the domain,it is concluded that our country should make clear the right attribute of virtual property of online games,standardize the responsibilities and obligations of game operators to improve their related inheritance system.Thirdly,to carry on the above research on the status quo of virtual property inheritance of online games,combined with China ’s actual,it is concluded that there are the following problems in the inheritance of virtual property in online games: difficult to confirm the subject of the inheritance,difficult to define the object of the inheritance,difficult to evaluate the value of the property,difficult to conflict between the right of inheritance and the right of privacy,and difficult to prove by the heirs,etc.,these are the traditional inheritance system is difficult to solve.Finally,on the entry into force of the Civil Code,in order to perfect the inheritance system of the virtual property of online games,the following suggestions are put forward: making clear the subject of the inheritance of the virtual property of online games,standardizing the object of the inheritance of the virtual property of online games,strictly standardizing the user agreement of online games,constructing the price evaluation mechanism of the virtual property of online games,balancing the conflict between the right of inheritance and the right of privacy,and establishing the principle of Reverse onus.Perfecting the inheritance system of the virtual property of network games is helpful to solve the increasing disputes of the virtual property of network games and guide the judicial practice of our country.
