The No.127 rule of general provisions of civil law,which is published in 2017,regulates online virtual assets.However,the location of online virtual assets in traditional civil law system is not clear.Hence,what is the definition of it?Is it a thing,power or intellectual property?There is not a common idea in literature and the same to the practice of law.The focus of this paper is the most active type of online virtual assets,which is online games' virtual assets.We hope that it can be helpful to explain,analyze multiple kinds of online virtual assets with its corresponding features,relative disputation statue and make some prospects about how to eliminate disputations.With the development of computers,the 4G network and carrier of online games,the online games' virtual assets appears in the area of mobile phone applications.Mobile game has made big progress and it brings much capital to platforms of online games.The players pay much attention and money into games to level up the character and upgrade the equipment.However,how to determine the nature of these behaviors?Online games' virtual assets plays a more and more important roles in current society with highly developed economy.However,virtual assets still needs to be adjusted and normalized.This paper begins from the definition of assets,profiles the definition of assets which is adjusted for law,tries to find out why online games' virtual assets belongs to assets and make the location of laws about online games' virtual assets clear.After that,we turn to adjust it based on current laws,refer the realities about the legislation and judiciary in other countries and make the reasonable choices.Finally,we make some prospects about the legislation of virtual assets in the literature of civil law.The first chapter is a detailed explanation about the spread of virtual assets,which discuss the purpose of judiciary and the origin of assets' conception.This chapter provides a theoretical base of the definition of virtual assets.In the second chapter,we refer the other countries' legislation,judiciary and relative cases to guide our countries' cases.Then,we analyze the main disputations between players,players and operators about virtual assets,give the legal location of it and clear up common situations.Finally,we discuss the fitness of virtual assets in our country's relative civil law and the adjustment of several kinds' feasibility and reasonability separately.Further,we give some advice about how to the legislation's adjustment related to online virtual assets.
