In accordance with the situation and request of “Seeing Party self-governance exercised fully and with rigor” and building a clean and honest government in the new era,the Central Committee of the Communist Party of China(CPC)has made the decision that the Commission for Discipline Inspection and the Supervisory Commission should work jointly from a historical and overall perspective.The Commission for discipline inspection supervises and enforces discipline in accordance with the Party Constitution and Party discipline,and the Supervisory Commission supervises and enforces law in accordance with the Constitution and the supervision law.The joint office is conducive to the integration of anti-corruption forces and the expansion of the scope of supervision,but it also puts forward higher and more urgent requirements for the connection of Party discipline regulations and national laws.The connection between the party's discipline and the national law(the standard formulation of the Central Commission for Discipline Inspection and the State Supervision Commission for this concept is "connection of discipline and law",hereinafter referred to as "connection of discipline and law")is the need of deepening the reform of the supervision system under the new situation,the procedural guarantee of the joint office between the Commission for Discipline Inspection and the State Supervision Commission,as well as the practical need of implementing the Anti-corruption Governance Concept of "coordination of pre punishment".Due to the open structure of law,the integration between the power of discipline inspection and supervision,and the political power structure with Chinese characteristics,there are also realistic possibilities and favorable conditions for this "connection of discipline and law".With the deepening of the practice of the joint office of the Commission for Discipline Inspection and the Supervision Commission,the government have explored the "link up of discipline and law" in the two aspects of legislation and enforcement,such as the link up between the newly revised regulations on Party discipline and the supervision law,the link up between the newly promulgated law on administrative sanctions and the regulations on Party discipline.Although these practices have made some achivements,there are still some deficiencies,which are mainly manifested in the following two aspects: in the legislation,the relevant party rules and national laws need to keep pace with the times,the transformation system of the inner-party laws and regulations to the national laws is inadequate;in the enforcement of discipline,there is a lack of smooth connection procedure between the Commission for Discipline Inspection and the Commission for supervision,the ability of comprehensively use the "four forms" of supervision and discipline is insufficient.According to the difficulties to be solved and the goal of deepening the reform of the national supervision system,this paper puts forward that in the future practice of discipline inspection and supervision,it is needed to further strengthen the leadership of the party,clarify the basic principles of the integration and connection of discipline and law.And it is also neccesary to improve the rules and regulations guarantee system and the integrated operation mechanism of the Commission for Discipline Inspection and Supervision Commission from the two aspects of legislation and law enforcement.To accurately use the "four forms" of supervision and discipline,effectively transform the institutional advantages of "connection of discipline and law" into governance efficiency,promote the full display of the advantages of the joint office of the Commission for Discipline Inspection and Supervision Commission,and constantly improve the anti-corruption system with Chinese characteristics under the unified leadership of the Party. |
