At present,our government is facing the crisis of aging and the pressure of the supply of elderly care services.In the age of population aging,how to meet the growing demand for services of the elderly is another major issue facing the Chinese government regions have begun to explore models in which the government purchases from third parties and the third parties provide elderly care services.The government purchases services from the original "sculler" to the "helmsman".The government's ability to provide services is improved,and the government is no longer a single service provider but has become planning and supervision.In the continuous practice of various places,the government's purchase of the old-age service system has become an important policy tool for improving China's old-age service system.The new mechanism for the government to purchase old-age services has become an important measure for the government to cope with the difficulties of old-age services in the context of socialization of old-age services.However,at present,there is still a serious "deficit of the rule of law" problem in the government's purchase of old-age service system.At present,most of the regulatory documents regulating the government's purchase of old-age service system are notices,policies,and other red-headed documents,which generally lack the standard and guarantee of the legal system.This article will analyze the legal problems existing in the government's purchase of pension services from the aspects of legislation,government responsibility,purchase process,evaluation and supervision mechanism through the study of several major government purchases of pension services in China.Put forward relatively complete suggestions from the aspects of legislation,supervision and evaluation.In terms of legislation,this article proposes that not only the basic laws for the government to purchase old-age services should be improved,but also relevant local supporting laws should be improved according to local conditions.In terms of supervision and evaluation,this paper proposes that a trinity of internal self-supervision,supervision by state agencies,and supervision by third-party assessment agencies should be established to build a more comprehensive supervision mechanism.
